CEI~T~RY AN~ DEDICATITdG IT AS A PIONEEI2
MEi~IORIAL PARK
WHEREAS, there is with~n the boundaries o~ the County
of Butte a cemetery known as the "Durham Cemetery", which ceme~ery
is described in Exhibit "A" attached hereto, and was historically
uti~ized to inter people in the Durham a~ea; and
WHEREAS, on August 7, 1979, this Boazd passed
~2esolution No. 79-164 expressing its intention to declare the said
cemetery abandoned as a place of future interment and to dedicate
it as a Pioneer Memorial Park after publication of said resolution
pursuant to the requirements of §$826 of the Health and Safety Code
and the holding of public h~arings on the question; and
WHEREAS, the said resolution has been published pursuant
to §8826 of the Health and Safety Code and public hearings held on
the question of abandonment of the Durham Cemetery and dedicarion
of it as a Pioneer Memorial Park; and
WHEREAS, the said cemetery is not at the present ti~ne
being utilized to inter human dead bodies and has nor been so
utilized in excess of five years preceding ~his date; and
WHEREAS, the cemetery in i~s presen~ condition endangers
~he health, safety, comfor~ and welfare o~ the public in ehat
recent activities bo~h in and surrounding said cemetery have caused
both desecration and obliteration ro the graves and markers, which
has created emotiional distress and discomfort for many;
IddW; THEREFORE, BE IT RESOLV~D that the cemetery known
as the Durham Ce:meeery and described in Exhibit "A" attached herEto
shall be and is hereby declared to be abandoned as a place o~'
future in~erment and is dedicated as a Pioneer t~emorial Park to be
maintained by the County of But~e so that it wi11 not endanger the

health, safety, comfort and welfare of the public.
BE IT FURTH~R RESOLVED that ~he Butte County His~orical
Society sizall be requested to investigate the possibility of causing
a suitable central memorial to be erected at the cemetery honoring
those who have been interred there.
BE TT FURTHE~ RESOZVED that this resolution shall be
recorded witt~ t11e County Recorder of the County of Butte.
PASSED AND ADOPTED by the Butte County Board of Supervisors
this 15th day of April, 1980, by ~he following vote:
