This matter came on regularly for hearing before the
]3oard o~ Supervisors of ~he County of Butte, State of California,
on May 6 , 1980, in the Board Chambers, Butte County
Administration Building, Ozova.lle, California, and it appearing to
said Board that a Notice of Time and Place of Hearing of said
Abandonment was duly and zegularly given as required by law, and
testimony and evidence, both oral and documentary, having been
produced at said hearing, from which said Board now finds fhat the
hereinafter described Public Uti~i~y Easement is unnecessary foz
present or prospective public use.
NOW, 'SH~REFORE, IT IS HEREBY ORDERED as follows:
l. That the public u~ility easement situated in the County
of Butte, State of California, as hereinafter more par~icularly
described is hereby abandoned.
2. That the c~escription of said public v.tility easement
so abandoned is siruated in the County of Butte, State of California,
and more particularly descxzbed as follows:
A por~ion of Section 26, T23N, R3E, MDM, and being
a portion of Lots 34, 37, 39, 40 and 41 as shown on
thar certain map of Paradise Pines Unit No. I5,
recorded in I~ap Sook 38, Pages 42 through 44 of
Butte County Official Records, more particularly
described as follows:
The southerly 12.00 fee~ of said Lots 34, 37, 39,
4fl and 41, excepting therefrom the westerly 10.00
feet of said Lot 40 and the easterly 10.00 feet of
sa~.d Lot 41.
3. That the Clerk of this Board shall cause a certified
copy of this Resolution, with the seal of the Board of Supervisors
of the County of Butte, S~ate of California, to be recorded in the
office of the Recorder of the County of Butte, State of California.
