This matter came on. regularly for hea~i~ng before the
Boa~d of Supervisors of the County of Butte, SCate of California,
on May 13 , 1980, in the Soard Chambers, BuCte County
Administration Building, Oroville, California, and it appearing to
said Soard that a Notice of Tiane and Place af Hearing of said
Abandonment was duly and regularly given as reqt~ired by law, and
testimony and evidence, both oral. and documentary, having been
produced at said hearing, from whick~, said Board now finds that the
hereinafter described Public Utili~y Easement is unnecessary for
present or prospective public use.
NOW, THEREFORE, IT IS HEREBX ORDERED as follows:
l. That the pub~ic utili~y easement situated in the County
of Butte, State of California, as hereinafter mo~'e par~icularly
described is hereby abandoned.
2. That the description of said public utility easemenC
so abandoned is situated in the County of Butte, State of California,
an.d more particularly described as follows:
Lot 195 of Kelly Ridge Estates Unit 4B, being a
portion of the west h.alf of Section 6, T19N, RSE,
MDM, and the southeast quarter of Section 1, T19N,
R4E, MDM, as recorded i.n Map Book 58, at page 73,
Butte County Official Records, more particular].y
described as follows:
Rights of way and easements for raarer, gas, sewer
and for overhead and underground wires for electric
and telephone services, togetlzer with ariq and all
appurtenances appertaining thereto, on, over, under
and together with the right ta trim or remove the
necessary trees, tree 7.imbs or brusli on tnose
portions o~ land more particularly described as a
strip of land six (6) ~eet in width within the lots
and contiguous to all side and rear lot lines.

RESOLUTION ABANDONING A PUBLIC UTIL~TY EASEMENT

appurtenances appertaining thereto on, over, under

necessary trees, tree limbs or brush on those partions
of land more particularly described as a strip of land
six (6) teet in width within the lots and con~iguous
to all side and rear lot Iines.
Said rights o£ way and easements petitioned herein
to be abandoned being cont~guous to the side lot
lines of said Lo~ 326, said right of way and ease-
ment contiguous to the rear 1ot 1ine; ot said Lo~
326 to be retained.
Excepting therefrom ~hat portion lying within the
setback o£ the adjoining county right of way.
3. That the Clerk of this Board sha11 cause a cer~ified
copy of this Resolution, with the seal of the Board of Supervisors
of the County of Butte, State of Cali~ornia, to be recorded in ~he
office of the Recorder of the County o£ Butte, State of California.
