This Board approves that certain agreement between the
County af Butte and McCain Associates for services as Engineer of Wark
~or Sacramen~o Avenc~e Assessment Distract No, l, Bu~te County, CaZifornia,
dated the 27th day of May, ~980, and attached to ~h~s reso~ution.
The Chairman of the Board is authorized to sign the agreement
and ~he County Clerk is au~.horized to attes~ its execution.

AGREEMENT FOR ENGINEERING SERVICES
Sacramento Avenue Assessinent District No. 1
This~•is an agreement for engineering services be~we~n
the COUNTY 0~' BUTTE, a political subdivision of the S~ate af California,
referred to as Cl.ient, and McCAIN ASSOC~ATES, referrEd to as Engineer.
1. Client retains Engineer as Engineer ot Work fo~ Sacra-
men~o Avenue Assessment District No. 1, Sutte County, California, to
perforin ~ th~ followa.ng se~vices :
(a) Prepara~ion of a map showing the proposed boundaries ot
the ass~ssment d~strict, in acca~dance with the require-
znents of Divis~on 4.5 of the 5treets and Highways Code.
(b} preparation of the report required by Sectzon I0204 of the
Straets and Highways Code (Municipal Tmprovement Act of
1923), and modification at the repor~ i£ directed by the
legislat~.ve body af Client. The repart shall include
the fo~lowing:
(1.) Plans and specifications for the proposed i~nprovement.
(2} A gen~ral description of improvements to be acquired,
if any, and a legal description of lands, rights-af-
way, easements or other in~erests in real praperty to
be acquired,
(3) An es~imate of the cost of the improve~ent, inc~udin.g
the cost af acquisitions and all incidental expenses.
(4) An assessmen~ diagram sho`aing ~he parcel.s of laind to
be assessed.
{5) A propased as~essmer~t of the total cost of the im-
provement an benefited parcels of land within the
assessrnent district.
(c) Compa.lation of a ~ist of the names and addresses af
a~l owners o~ land within the assessment dis~rict in
accordance with recards of the County Assessor or in
accordance with title reports provided by the Client.
{d) Pasting of no~ices of improvement on all op~n streets
within the assessment district at distances not greater
~han 300 feet apart. Copies of notice of impravement
for po~~ing are to be provided by the Cla.ent.
(e~) Canstruction staking.
~) Inspection of the work o~ Client's can~ractor and
certification to the CLien~ of the con~ractor's entitl~-
ment to progress paymen~s.
~) A~tendance at mee~ings of Client's leg~sla~ive body,
when requested by Client's staff, for the purpose of
presenting and seeking approval of the documents and
reports described in subparagraphs (a) through {d).
{h) A~tendance at all other public meetings of Client at
~ which matte~s relating to the assessment district are
consid~r~d, except routine matters.
(~} A~tendance a~ staff inee~~ngs or meet~ngs of praperty
owners upon the request of the Client, after reasvnable
notice.
(j) Te~ephone consuZtation with staff inembers and proper~y
owners to answer eng~neering questions about the assess-
ment proceedin~s.
~) Prepara~ion of change ord~rs as may be requi~ed during
the course of construction.
(1) P~eparation af a f ina~ cos~ schedule after completion
of the improvement and payment of all inciden~al ~xpense.
{m} Appraisal and right-of-way acquisitian services.
2. The services of Engineer under this agreement shall not
inc~ude the following: ~
{a) Prepara~ion of an environmental assessment, to de~ermine
whe~her the improvement wi~l have a significant impact
on the enviranment within the meaning of the Ca~i~ornia
Environmenta~ Quality Act.
(b) Pr~paration of an Environmental ~mpact Report
3. Tn consideration of the services se~ farth in Paragraph 1~
Client shal~ pay to Engineer the following fee and costs:
Standard Haurly Charg~s, as set ~orth and shown on Exhib~~ A
at~ached to this agreement, which said Exhibit A is, by
this reference, incorporated her~in, pravided that the aggr~-
gate total of all charges does not exceed $124,a00.00.
In no even~, however, wi~l the compensation o~ Engineer exceed the
amaun~ se~ forth by Enqineer for tha~ purpase in the Repor~ prepared
by ha.m under Section 10204 of the St~eets and Highways Code.
4. The compensation of Second Party hereinabflve set
~orth shall be de~ermined in accordance w~th Exhibit A at~ached
hereto, and said sum sha~l be charged ~o and paid on~y f~om the in~
cidenta~ expenses for sa~d assessment district and from no other
source or ~und except that in the event First Party does not proceed
with this assessment distric~ p~oceeding past the hearing on the
Resolution of Intention, then Client shall pay Engineer in accordance
with said Exhibit A from funds other ~han the incidental expenses
for said assessment district, no~ to exceed One Hundred Thousand
Dollars ($100, 000. 00} . ~

STANDARD HOURLY CHARGES
