HomeMy WebLinkAbout80-125WHEREAS, the County Clerk is constitutionally empowered to serve as ex-officio clerk of the superior court; and WHEREAS, the County Clerk is mandated to collect the fees specifSed by law when fi7ing and processing the court's documents; and WHEREAS, the current ftling fee schedule pertaining to civil, probate and family law actians is inadequate to maintain an acceptable tevel of service for citizens seekfng judicial redress; and WH~REAS, it has been determined that taxpayers have been subsidizing the County Clerk's budget to pay for the costs of filing and processing civil, probate and domsstic relat9ons actions; and WHEREAS, many fees have not been changed since 1986 and increases which have no~ kept pace with the continual rise in the cost af living; and WHEREAS, local government will comply with legal mandates but also requires adequate revenues in order to carry out those mandates, NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors, Coanty of Butte, supports the passage of AB 2361 introduced by Assemblyman Frazee, which would increase certain superior, munfcipal and justice courts filing fees and allow the County to collect t~e proper revenue from which to fund these court services. NOW, THEREFORE, BE IT FURTHER RESO~VED, that copies of this resolu~ion be forwarded to 5enator Witson, Senator Presley, Senator Beverly, Senator Maddy, Senator Nejedly, Senator Rfchardson, Senator Robbins, Senator Roberti, Senator Sieroty, Senator Johnson and Steve Zehner, CSAC.
