RESOLUTION ACCEPT~NG PRQPOSAL FOR S~EC~AL
ASSESSMENT PROCEED~NGS FOR
EAST RIDGE ASSESSMENT DISTRICT
The Board of Supe~viso~'s of the County of Butte resol.ves:
Heritage Constructian Co~npany ("the develaper") is ~o under--
take the construction of the ~olZowing desc~ibed pu.bl~c improvement:
The construc~ion of those streets narned ~astridge Court, Oakridge Court,
and Rogers Ridge Couxt, as shown on tha ~ract zna~, in accordance wit3~~
Sutte County Pnblic Wor3cs 5tandard RS-3-B ~i~ocal Access RAad); th~ construc-
tion of ~ransitions at the i.ntezsection of Bast~idge Court wzth Kelly Ridge
Road and at the inte~secti.on o£ Rogers Ridge Court vxith Heri~age Road; t.he
construction of an undergxaund stor~i drainage system to service the entire
tract; the construction of sewer mains and sewer service laterals s~ubbed
to each parcel at the righ'~-of--wap line~ which wall become a part of the
Nor~h ~ Burbank PubZic ttti~.ity Di:s~rict sewage clzsposal netwarlc; the construc-
ti.an of domestic wa~er maa.as and water sex~tic~ laterals stubbed to each par--
cel at ~he s'~ree~ right-o~--way 1ine, which wi11, become a part of the 4xavi1le-
Wyando~.te Irrigation Distxict water supplp network; and the construction o~
undergro~nd puh3.ic utili.ty fac~lities stubbed to each ~arce~ at the street
right--of-way line, which-will. inciude P.G. &~. elec~rical facilities,
P.T.&T. ~elephone facilities, and open conde~i~k for future cabl.e televisian
a.nd street lighting faciiities. ~
The developer has proposed to this Board that the Boa.rd of
Supervisors unde~~ake specia~ ass~ssment proceeding5 to acquire these
public impra~vements a£te~ their compls~ion, the cos~ o~ the acq~isi-
tion to be assessed an property o~ the developer be~efitinq from th~
~.mprove~nents .
This Board ofi Supervisors accepts this proposal in princip3.e,
subject to the ~o,~~aw~ng condi~ions:
- ].. That the specia~. assessment proceedi.ngs shall be taken
under ~he Municipa~. ~mprovement Act of 1913, with improvernen~ bonds
to b~ issued under the ~mprovement Act of 1911.
2. That the described improvements shall be certi~ied
by the Directo~ of Public Warks as co~nplete and ready for accept-

ance before the adop~ion of the reso~ution o~ intention.
3. That the devel.oper shall si~bznit evidence satisfactory
to this Board that the cos~s proposed to be assessed shall have been
actually incurr~d ancl pa~d, and ~hat the land proposed to be assessed
sha~1 be free of inecha.nics' liens resu~~ing f~om the cans~.zucta~on. af
the improv~ments.
Thzs resolution shal~ izz no way consti~ute a guarantee or
a5surance that the special assessFnent proceedings wi11 be comple~.ed,
~.he Board af Supervisoxs being wi~hout juxisdiction~to assur~ th~
~.evy of special assessments txntil conducting a pub~.ic hearing as
requz~ed by the Mun~.ci.pal Sznprovement Act af 1913.
I HEREBY C~RTIFY that the fox~egoing xesoltztion was duly
and regularly adopted by the Board ot Supervisars of the County a~
Bu~te, State of Ca~ifarnia, at a regular meeting thereaf, held on ~he
29th day a~ Juiy, ~980.
