WHEREAS, the Board of Supervisors finds it to be in the interest
of the county to amend the personnel rules.
NOW, THEREFORE, BE IT RESOLUED, the Board of Supervisors of the
County of Butte hereby amends Section 2.36 ofi the personnel ru7es of the
County of Butte to read as follows:
2.36 Th~MEDIATE FAMILY
The fo~lowing members of an employee's family: spouse; natural,
step or ~egal child or parent; brother; sister; grandchild;
grandparent; mother-in-law and father-in-law.
NOW, THEREFORE, BE IT FURTHER RESOLVED, the Board of Supervisors
of the County of Butte hereby amends Section 13.2 of the personnel
ru~es of the County of Butte to read as follows:
13.2 SICK LERVE
a. Empioyee Sick Leave.
Regu7ar employ:ees shall earn sick leave at a rate of
0.4675 days for each completed unit of service or prorata
portion. Unused sick leave may be accumulated without
7imitation during a continuous period of employment.
Extra-help employees shall not earn sick leave.
Sick leave shall nat be considered a privilege to be used
at the employee's discretion. It shatl be allowed only in
case of necessity for actuaT sickness or disability.
Except in emergency in order to receive sick leave
compensation whi7e absent, the employee shall notify the
appointing authority prior to or with~n (4} four hours after
the time set for the beginning of the employee's work
shift. The employee shaiT upon request file a physician's
certificate w~th the appointing authority stating the cause
of the absence and the employee's physical ability to
return to work.
Sick leave time allowed shal~ be charged to the emp7oyee's
accrual and paid at the employee's current rate of pay.
b. Sick Leave Buy-Back Option.
Upon retirement or termina~ion in good standing an employee
who has ort accrual mo re than (30) thirty work days of sick
leave may be compensated for that portion over (30) thirty
work days at (1/2) one-haTf the normal rate of pay for the
employee up to a maximum of {$1500) one thousand five hundred
do17 a rs .

c. Critical Illness in Family
Whenever a regu7ar emp7oyee beiieves it necessary to be
absent from duty because of the critical illness of an
immediate family member, the employee may request permission
of the appoin~fng author~ty to be absent for not more than
(3} three working days with pay.
Any time off shall be charged against sick leave.
NOW, THERE~ORE, BE IT FURTNER RESOLVED, the Board af Supervisors
of the County of Butte hereby amends S:ection 13.5(a) of the personnel
rules of the County of Butte to read as follows:
13.5 HOLIDAY LFAVE
a. Designated Holidays
Each regular employee in a compensated empToyment status
on the assigned work day immediately preceding and the
assigned work day immediately folTowing a designated
ho79day shall be entitled to compensation for the designated
holiday. The following halidays are designated:
1) New Year's ~ay January 1
2) Washington's Birthday Third Monday in February
3) Memorial Day Last Monday in May
4) Independence Day July 4
5) Labor Day First Monday ~n September
5) Admission Day September 9
7) Veterans Day November 11
8) Thanksgiving Day Designated Thursday in November
9) Post-Thanksgiving Day Friday following Thanksgiving Day
10) Christmas Day December 25
11) Every day appointed by the President or Governor for
a gublic fast, thanksgiving or holiday
When a designated holiday fa11s on Sunday, the fo7lowing
Monday shall be observed. When Veterans ~ay fa71s on
Saturday, the preceding Friday shali be observed. A
regular employee required to work on a designated ha1iday or
whose regular schedu~ed day off falls on a designated
holiday shall at the cliscretion of the appointir~g authority.

NOW, TFEER~FORE, BE IT FURTH£R RESOLVED, ~he Board o'F Supervisors
of the County of Butte hereby amends Section 13.9 of the personnel
rules of the County of Butte to read as follows:
13.9 HEALTH INSURANCE
a. ~ligibility.
All county officers and reguTar empZoyees assigned to a
(1/2) one-half time or r~ore posi~ion and the employees'
dependents shall be entitled ~o parttcipate in the county~
sponsored group health insurance program. Elig~ble
employees enrolling in ~he program within (30) thirty days
fo7lotving their appaintment will be insured subject to the
contract 1imita~ion with the insurance carrier. Emp1oyees
enrolling after the (30) ~hirty day enrollment period wi11
be approved only upon evidence of insurabiTity. Regu1ar
employees assigned less ~han (1/2) one-half time and extra-
he3p employees shall not be e~igible for partfcipation fn
the health insurance program.

b. Premium.
Employees shall pay (10} ten percent of the total monthly
premium for employee and dependent coverage to be paid
through a payroll deduction unless otherwise specified in
this section. To be eligfble for premium sharing, an employee
must have no less than the total of (10) ten days of compensated
employment occurring within the (2) two regular pay periods
immediately preceding the pay period from wh~ch the premium
deduction is made.
Employees with less than the required compensated days of
empToyment may continue coverage by advancing ta the Auditor
the tota7 premium amount for the month. For the purpose of
this section only, an employee on an approved industrial
disability leave of absence, who is receiv~ng temporary
disability payments from the compensation insurance fund
shal~ be considered in ful7 compensated employment status.
An insured employee granted an approved non-co~pensated
Teave of absence may continue health insurance coverage
by advising the Personnel Director and advancing to the
Auditor each month, the total monthly premiUm cost.
c. Retired Employee Options.
Elected and appointed department heads or afficials retiring
in good standing before age 65 from the County of Butte
under the provisions o~ the county's contract with the
Public Employees' Retirement System (PERS) may cantinue to
insure themselves and e7igible dependents for the basic
health and catastrophic insurance. The county shall pay
the full premium for such coverage until the retiree becomes
65 years of age or is covered by another governmental
or employer-paid hea7th plan. Appl~cat~on for post-retirer~ent
health coverage shali be made to the Personnel Director,
prior to the officiai termination date af county service
in a manner and form prescribed by the Director.
~mployees who retire under the provisions of the Caunty's
Retirement Contract with the Public Employees' Retirement
System (PERS} may continue to insure theroselves and their
~insured dependents for the bas9c health and catas~rophic
insurance by advising the Personnel Director and advancing
the full premium for insurance coverage in a manner prescribed
by the Personnel Director.
Employees with (10) ten years of cantinuous service with
Butte County who, upon terminat9on, immediately retire
under the provisions of ~he county's contract with the
PubTic Emp7oyees' Retirement System shall be eligible for
pre-paid basic health and catastrophic insurance premiums
(emp7oyee on1y) to age (65) sixty-five years under the following
conditions:
1) PERS safety members shall be permitted as an
option to the sick 3eave buy-back plan specified in
Section 73.2(a) of these rules to receive (1) one
month of pre-paid heal~h insurance premiums for each day
of sick 7eave on accruai at the day of retirement.
2) PERS misce3laneous members shall be entitled to (12)
twelve months of pre-paid health insurance premiums
immediately fo7lowing retirement. In addition,
miscellaneous members are perm3tted as an option to the
sick leave buy-back p7an specified in Section 73.2(a)
of these rules to receive (i) one month of pre-paid
health insurance premiums for each day of sick leave on
accrual a~ the day of retirement.
Employees selecting a post-retirement health insurance
p~an shaTl fi1e notice with the Personnel D7rector (30)
~hirty days before the effective retirement date in a manner
and form prescribed by the Personnel Director.

NOW, THEREFORE, BE IT FURTHER RESOLVED, 't'he Board o~ Supervisors
of the County of Butte hereby amends Section 13.10(e) of ~he personne7
ru1es of the County of Butte to read as follows:
13.10 TRAVEL AND EXPENSES
e. Expenses for Mileage
Any officer or employee who has received authorization
to use a privately-owned vehicle for county business
shall be reimbursed at a rate of (24) twenty-four cents
for each mile driven on county business during ~he month.
Any offieer or employee, except Board and Commission members
specified in these rules, who during any month is authorized
and provides a privately-owned vehic7e for county use in
excess of {5) five working days during the month shall
receive {$24) twenty-four do3lars for the first (100)
one-hundred miles or portion thereof of miles traveled
on county business. Such officers and employees shall
receive in addition after the first (700) one-hundred
miles per month, (24} twenty-four ce~ts a m~le for all
other ~iles traveled on cvunty business during the month.
The County Administrative Officer shall develop rules and
procedures for the authorization of vehicle use under this
section. Such procedures sha7i provide for the written
departmental justification of need, written m9leage records
certified by the department and the employee, periodic
review of trave3 needs by the department and the type and
condition o~ vehicie authorized for county use.
NOW, THEREFORE, BE IT FURTHER RESOLVED, the Board of Supervisors
of the County of Butte hereby adds Section 12.16 to the personnel
rules of the County of Butte to read as follows:
12.16 LAW ENFORCEMENT STAND-BY PAY
a. Status.
Effective September 27, 1980 regular employees in law enforcement
c7ass~fications as set forth in this section shall be
entitled to receive ($20) twenty doTlars for each
(8) eight-hour stand-by shift or portion thereof ordered by
the appointing authority:

Deputy Sheriff Sheriff's Sergeant
District Attorney's Investigator T Welfare Investigator I

b. Response Time.
Employees placed on stand-by status shall keep the
appointing authority,advised of ~heir location during the
shift and sha17 respond ~o duty within (1) one hour from
the time of notification.
Emp1oyees on stand-by status shalj not be eligible for
call-back pay as specified under Section 12.14(i) of these
rules. £mployees returning ~o duty from stand-by shall
be eligible for overtime as specified in these rales.
c. Records.
The appointing authority shall maintain pre-authorization
s~and-by records specifying the employee's name, classification,
the reason for s~and-by, the date and specific sh~fts for
stand-by, the response duty station, ~e]ephone number to reach
emp~oyee and o~her pertinent information determined b.y the
appointing authority.

NOW, THEREFORE, BE IT FURTHER RESOLVED, the Board of Supervisors
of the County of Butte hereby adds Section 12.Z7 to the person~e7 ruies
of the Coun~y of Butte to read as follows:
12.17 SHIFT DIFFERENTIAL PAY
Effective September 27, 1980 a regular emp7oyee who is required as
par~ of a normal work schedule to work a majority of the shift
between the hours of 5:00 p.m. and 7:00 a.m. shail receive in
addition to regular pay $2.40 for each shift worked as shift
differentia7 compensation. Emp1oyees sha77 not be entit1ed to
shift differential compensation while on sick ieave, vacation, or
other paid leaves. The reassignment by the appointing author9ty
of an employee from a shift covered by differentia1 pay to a shift
not covered by differential pay shall not be considered as a demotion
or loss of pay and sha~1 not be subject to the grievance or appeal
process.
