HomeMy WebLinkAbout80-185WHEREAS, heretofore on the 22nd day of July, 1980, the Board of Supervisors of the County of Butte, State of California, adopted and passed a resolution of notice of intention to establish county service areas to be entit].ed County Service Area No. 75 (North Park Subdivision Streetlights) and County Service Area No. 76 (Quail Run Subdivision Street].ights and Drainage); and WHEREAS, said resolution fixed the 26th day of August, 1980, at '10:00 a.m. of said day in the Board of Supervisors' Room of the County Admittistratzon Center in ~he City of Oroville, State of California, as the time and place for the public hearing on the establishment of said area and the assessment of a per parcel service charge; and WHEREAS, said Board at said time and place proceded to hear arguments both for and against the estab7.ishmen~ of said area and the assessment of a service charge; and WI~REAS, no written grotests agains~ the establishment thereof were filed in accordance with Section 25210.17 of the Government Code. NOW, TIi~REFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California, as fo3lows: 9. That said Soard hereby finds and determines that proceedings herein were conducted pursuant to Section 25210.1 et seq of the Government Code and that publication and notices were given pursuant thereto and that said ~oard finds and determines that the extent to whioh the services described in the resol~ztion of intention are extended county services. 2. That said Board hereby determines to establish said county service areas. 3. That the boundaries of said service areas are hereby finally, de~ermined and established to be the same as are shown on Exhibits "A" attached hereto and incorporated herein by reference and made a.part of by this resolution. RESOLUTZON ESTABLISHIN~ COUNTY SERVICE AREA N0. 75 (NORTH PARK SUBDIUISION S~REETLIGHTIN~) AND COUNTY SERVICE AREA N0. 7b (QUAZL RUN STREETLIGHTS AND DRAINAGE). ~. That the name of said service areas so established is County Service Area No. 75 North Park 8ubdivision Streetlights and County Service Area No. 76 Quail Run Subdivision Streetlights and Drainage. 5. That the type of extsnded county service area to be provided wa.thin said areas is County Service Area No. ~5 streetlighting and County Service Area No. ~6 streetlighting and storm water drainage. 6. In accordance with ~he provisions of the Butte County Code Sections 21-85 through 21-90 a per parcel service charge shall be levied against all the parcels within County Service Areas No. 75 and ~6 as described in the report filed with the Clerk of the Board of Supervisors on July 28, ~g8o. Each parcel shall be assessed a flat per parcel service charge as indicated in tne report in order to finance the cost of the extended services. Said charge shall appear as a separate item on the tax bill and shall be collected at the same time and in the same manner as ordinary county ad valorem taxes are collected and shall be subject to the same penalties and the same procedure and sale in the case of @elinquency as provided for such taxes. Al1 laws applicable to the levy, collection and enforcement of county ad valorem tax~s shall be applicable to such charge, except that if real property to which such charge relates has been transferred or conveyed to a bonafide purchaser for value, or if a lien of a bonafide encumberer for value has been created and attached thereon, prior to the date on which the first installment of such taxes would become delinquent, then the charge confirmed gursuant to this resolution shall not result as a lien against said xeal.property but instead shall be transferred to the unsecured roll for collection. ~. That said county service areas are established for all pu~poses subj~ect only to compliance with the requirements of Chapter 8, Part T, Division II, Ti~le V of the Government Code and subject to the provisions of Article 2.5, Chapter 2.2, Part I, Divisian II, Title III of the Government Code of th~e State o~ California.
