intends to consider a proposal for dissolution of a county service
area; and
WHEREAS, no proceeding for the dissolution of such a
service area shall be instituted by this Board or required by its
members until approval of the Local Agency Formation Commission is
first obtained.
NOW, THEREFORE, BE iT RESOLVED AND ORDERED by the Butte
County Board of Supervisors as follows:
1. Application and a proposal for dissolution o£ County
Service Area No. 53 is hereby made to the Butte County LocaZ Agency
, Formation Commission in accordance with the District Reorganization
Act, Revenue and Taxation Code §§56000, et s~. The exterior
boundaries of the servica area are described in Exhibit "A" attached
hereto and made a part hereof by this reference.
2. Dissolution of said service area is proposed under
the County Service Area Law. The type of extended service proposed
' to be dissolved is structural fire protection services.
3. Pursuant to Revenue and Taxation Code §99, the funds
generated within County Service Area No. 53 for structural fire
protection sarvices sha7.1 be transferred to the County of Butte.
4. That all obligations due and owing by County Service
Area No. 53 shall be assumed by the County of Sutte;
5. The reason for the proposed dissolution is that an
extended level of structural fire protection services no longer
exists.
6. The Clerk of the Board is authorized and directed ~o
file a certified copy of this resolution with the Executive Officer
of the Butte County Local Agency ~orm.ation Commission.
