RESOLUT~ON OF ~NTENT~ON TO ORDER ZM~RQVEMENT IN
SOUTH ~ROVILLE ASSESSMENT DISTRICT
The Board a~ Supervisors o£ the County of Butte resolves:
Thi.s Board in~~nds t~ order ~h~ fo~lowing improveanent under
the authority of the Mun~.cipal Improvement Act o~ ~.913:
Cons~ruction of storm drain faciZiti~s and filling in
and obliteratzng an exis~ing open ditch crossing pri-
vate and public property i~ the cammuni~y of South
Orovi~le, California; cons~.sting o~ 348 lineal feet
of 66" concrete pipe on Roseben Av~nue between zthaca
an.d Oraville-Bango~ Highway, i820 1~.neal ~eet of 60"
concre~e pi,pe on Oroville-Bangor Highway, Fal~brook~
Aven~xe, Fort Wayne Street anrl Burl~.ngton Avenu~, and
375 li.neal ~eet o~ 54" cvn.crete pi.p~ on E1gin Street
runr~ing east ~rom Bu~lington, together wi~h the nec-
essary drop in~ets, manholes, in~et structures, s~reet
and u~i~.ity repairs and tree rep~acemen,ts, and a3.~. o~her
imp~oveznen~s and appurtenances necessary ~or a camp~.e~e
and operab].e storm drain and the complete and arderly
obl,iteration a~ ~he exi,s~~.ng open drain.
This Board finds tha~ ~he land special~y ben~fited by
~he improveinent is shown within ~he boundaries o~ the map enta,tled,
"Proposed Bounda~ies o~ South Orovi~.le Assessment Distriat, County
o~ Butte, State o~ Ca].i~orn~.a." This map has been approved by the
Board of Supervisors and is now on fa,3~e with the Coun~y C~.erk. The
land within ~he exte~ior boundarzes shown az~, the xctap shall b~ desig-
nated South Oroville Assessment Dis~ra.ct, County of Butte, State of
California.
This Board in~tends ~to levy a special assessment upon the
land within the described district in accordance with the special
ben~~it to be x~eceived by each parce~ of 1and, respectzvely, fraz~
the impravement. There shal7. be omitted from special. assessment all
public stree~s, alleys and plac~s and all Zand belonging to the United

Stat~s, the State of Califo~nia, and this Caunty now in use in the
perfarmanc~ of a public function.
Where any disparity occurs in xevel or size between the
improvement and private prope~ty, this Board determines that ~t is
in the pub~ic interest and more economica~ to elimina~e the disparity
by doing work on the private property instead of adjus~ing ~he
work on pubiic prop~r~y. Accord~ngly, work may be done on private
property for this purpose wi~h the wr~tten consent of the landowner.
Seria~ bonds represen~ing unpaid assessments, a~d bear~ng
interes~ at a rate not ~o exceed ten percent (l00) per annum, wi~l
be issued in the mann~r provided by the Improvement Bond Act of ~915
fDiv~s~on 10, Streets and Highways Code), and the last installment af
~he bonds shall ma~ur~ four {4) years fram th~ second day of Ju~y~
next succeeding ten (10) months from their date.
This Board appoints CLAY CASTLEBERRY, Direc~ar of Public
Works, County of Butte, as ~ngineer of Work fo~ ~his project, and
directs the preparation of the report required by Section 1020~ of
the Streets and Highways Code.
Tn the opinion of this Board, the publ~c interest will not
be served by allowing owners of assessable lands ~a enter into a
contrac~ for the work of improvement, as otherwise p~rmit~ed in
Section ~0502.2 of the Stre~~s and Highways Code.
The amount of any surplus remaining in the improvement fund
after completion of the improv~ment and paymen~ o~ a11 claims shal~
be trans~erred to the gene~a~ fund ~f the surp~us does no~ exceed
the lesser of ane thousand dollars ($~000) or fivg percent (~~) o~

the total amount expended from the fund. Otherw~se ~he ~ntire surp~us
shall b~ applied as a credi~ on the assessment as provided in
Section 10427.1 of the Streets and Highways Cade.
