Soard of Supervisors of the Countq of Butte, State of California,
on Navember 4, 1980, in the Board Chambers, Butte County
Administration Buzlding, Oroville, California, and it appearing to
said Board that a Notice of Time and Place of Hearing of said
Abandonment was duly and regularly gzven as required by law, and
testimony and evidence, both oral and doctun.entary, having been
produced at said hearing, from which said Board now finds that the
hereinatter described Public Util~ty Easement and Recreational Ease-
ment is unnecessary for present or prospective public use.
NOW, THEREFORE, I'T IS HEREBY ORDERED as follows:
1. That the public utility easement and recreational ease-
ment situated in the County of Butte, State of California, as herein-
a~ter more particularly described is hereby abandoned.
2. 'That the description of said pubJ.ic utility easement
and recreational easement so abandoned is situated in the County of
Butte, State of California, and more particularl.y described as

This Co~ncil finds that the ~and specia~~y benefited by

entitled, "Amended Baundaries~of Northeast Chico Sewer Assessment
District, Cit~ of Ghaco, County of B~tte, S~ate o~ Ca~ifornia•"
This map has be~n approv~d by the Council and is now on fzl~ with
the City Clerk. The land within the e~terior bounda~ies shown an
the map shal~ be d~signated Northeast Chico Sewer Assessment Dis-
trict, City o~ Chico, Caun~y of B~tte, State o~ Cal~~ornia.
This Council intends to ~evy a 5pecial assessment ~pan
4he ~and wzthin the described district in accordance with the
special benefit to b~ ~eceived by each parcel of ~and, respect-
ively, fram the improvement. There shall be omitted ~rom special
assessrnent a11 public street5, al~eys and places and a11 land
be~onqing ~o the United States, the State of California, and this
City now in use in the ~performance af a publ~c function.
This Council ~.ntends to make from time to time a partial
contribution toward the cost of the work ta be ordered and th~:
acquisitions to be made. The amount of said contr.ibution sha~.l be
set ~or~h in an ordin.ance to be adopted by this Council, which
ordi.nance sha1Z be adop~ed pursuant ta the provisions of Section
10205 of the St~eets and Highwrays Code o~ the Sta~e of Cala.fornia.
Where any disparity accurs in leve~ or size between the
improvement and private proper~y, this Counc~l determines that
it~is in the public interest and more economical to eliminate thE
dispar~.ty by doing work on the p~ivate property i.nstead ~f adjus~~
ing the work on pub~ic propez~y. Accordingly, work may be done
