RESOLUTION F2NDING AND DETERI~9INING THAT THE
PUBLIC CONVENTENCE AND NECESSITY R.EQUIRE THE
CONSTRUCTION OF T~E IMPROVEMENTS
SOUTH OROVILLE ASSESSMENT DISTRIC~
The Board of Supervisors of the County of Sutte resolves:
A public hearing for which notice has been given by publica-
tion, posting and mai~ing, has been held as to the public convenience
and necessity of the improvements in South Oroville Assessment Dis-
trict, County of Butte, State of California.
This Board has heard and considered a11 the evidence,
both oral and written, relative to the public convenience and neces-
szty of the construction of improvements, and finds that the public
convenience and necessi~y require ~he following improvements proposed
to be construc~ed in South Oroville ASS'ssn~nt District:
Constructzon of storm drain facilities and
filling in and obliterating an existing open
ditch crossing private and public property
in the community of South Oroville, California;
consisting of 308 lineal feet of 66" concrete
pipe on Roseben Avenue between I~haca and Oroville-
Bangor Highway, 182Q lineal feet of 60" concrete
pipe on Oroville-Bangor Highway, Fallbrook Avenue,
Fart Wayne Street and Burlington Avenue, and
375 lineal feet of 54" concrete pipe on Elgin
Street running east from Bur~ington, together
with the necessary drop inlets, manholes, inlet
structures, street and utility repairs and tree
replac~ments, and all other improvements and
appurtenances necessary for a comp~ete and
operable storm drain and the complete and
orderly obliteration of the existing open drain.
and further determines that the Special Assessment Investigation,
Limitation and Majority Protest Act of 1931 sha1Z not apply to these
assessment proceedings and that this project shall proceed in accord-
ance wxth the terms and provisions of the Municipal Tmprovement Act
