HomeMy WebLinkAbout80-246RESOLUT~ON NQ. 2~ RESOLUT~ON APPRQVING REPORT AND ASSESSMENT AND ORDERSNG IMPROVEMENT SOUTH OROVILLE ASSESSMENT DZSTR~CT The Board of Supervisars at the County of Butte resolves: This Baard has taken a ser~es of actions preli.minary ta vrder~.ng the improvement in South Orovx~~e Ass~ssment District, County o~' Butte, State of Cala.~ornia, and now makes ~he folZowing findings and orders: l. The Board of Supervisors adopted a map showing th~ bounda~ies of the land benefited by the proposed improvement. A copy of ~h~ boundary map was ~iled in the of~ice o~ the Couxzty Recorder of the County o~ Butte in the Book ot Maps of Assessment Districts. 2. The Board of Superviso~s adopted its resolution of intention to order the imp~ovement described therein under ~he MunicipaZ Improveanent Act of ~9i3, and direc~ed the Director of Public Wo~ks, as the Engineer of Work €ar the assessrnent district, to prepare the zepor~ requir~d by Section 1Q204 of the Streets and Highways Code. The improve~nent is general~y desc~ibed as follows: Can.struction of storm drain facilities and fi1.~.ing in and oblitera~ing an exist~ng open ditch crossing p~ivate and publ~.c property in the comrnunity of South Orov~.l.~e, California; consis~ing of 308 l~neal feet of 66" concrete pipe on Roseben Avenue between zthaca and Orovil~.e- Bangor Highway, 1820 lineal feet of 6Q" concrete pipe on O~ovil.l.e-Bangor Highway, Fal~broak Avenue, -1- ~fJ11Q~~11VQ~ Fort Wayne Street and Burlington Avenue. and 375 ~ineal f~~~ of 54" concrete pipe on E1gin Stree~ running east from Burlington, together with the necessary drop xn~ets, manho~es, inl~t structures, street and ut~~ity repairs and tree replacements, and al~ othex improvements and appurt~nances necessary for a complete and operable storm drain and the comp~ete and orderly obli~eration of ~he exzstzng open drain. 3. Th~ Enginee~ of Work ~iled the report as directed, and the Board o£ Supervisors ca~led a hearing on the report as required by Sectxon 10301 of the Stree~s and Highways Code. Notice of the hearing was gzven by pub~ication, by street posting and by mailing to affected p~operty owners, a~l accarding to ~he M~nici- pa~ Impravement Act of ~913. Affidavits of pub~ica~ion, pos~ing and mai~~ng were filed with the County C~erk. 4. At the t~me and plac~ ~or which natice was given, the Board af Supe~visors conducted a public hearing and gave ~ve~y interested person an opportunity to object to the proposed improvement, ~he extent of the assessment distr~ct, or the pro- pased assessment. . ~. The Board af Supervisoxs finds~that~the wr~tten pro~ tes~s against the propQSed ~mprovement have not been made by owners representing more than ane-half o~ the area of the land to be assessed for the improvement. 6. The docu~nents and ~vents described in paragraphs I to 4, inclusive, are stated here in tabu~ar form, wi~h their dates and, where appropriate, thezr numbers. The Board of Supervisors approves the Eng~neer's Report and each campanent part of ~t, includi,ng each exhiba.t a.ncor-- porated by refe~'ence in the report. 8. The Board of Superva.sors finds that the Engineer of Work, in the Report, has tairly and proper7.y apportioned the cost of the improvement to each parcel of ~and in the assessmen~t district i.n proportion to the estimated benefits to be received by each pa~ce~., respectively, ~ram the improvement. The Boa~d of Superva.sors he~eby con~irms and levies each i~dividua~ assessment as sta~ed in the Engineer's Report.. • 9. This Board of Supertri.sors orders the improvement des- cr~.bed in paragraph 2 and as detai~.ed in the Eng~neer's Reporta 10. ~erial bonds representing unpaid assessments, and bearing interes~. at a rate ~zot to exceed ten perc~nt (10~) per annuin, will be issued in the manner provided by the zmprovement Bond Ac~ a~ 1915 {Division 10, Streets and Hiqhways Code), and the ].ast insta].~.ment of the bonds 5ha1.~. mature four (4} years ~xoxn the second day of Ju1y next succeeding ten (1~) months ~rom their date. -3~- 11. According to Section ~0603 of ~he Streets and High- ways Code, the Board of Supervisors des~gnates the County Treasur~~ to coZ~ect and recEive payment of ~he assessments. ~ ~ ~ .
