HomeMy WebLinkAbout806 ORDINANCE N0. 806 ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CAT.IFORNL4, 1 PURS[TANT TO ORDINANCE NOS. 475, 522 and-676 OF SAID COUNTY 2 The Board of Supervisors of the County of Butte, State cf California, under and pursuant to Ordinance No. y'15 of said County, being the Zoning En- S abling Ordinance of said County, as amended by Ordinance Nos. 522 and 676, Does Ordain as follows: 4 SECTION 1. The hereinbelow described areas, situate in the County of 8 Butte, State of California, shall be and.it is.herEby zoned as an:"A-3°'-(Agri- cultural) District, and such areas shall be subject to the restrictions and 6 restricted uses and regulations hereinafter specified-and provided, said areas so zoned being located in the unincorporated area of Butte County, Berry Creek, '~ California, and particularly described as follows: Assessor Parcel Nos. 37-06-10; 61-08-07; 62-26-05; 62-26»07; 62-.26-09; 62-26-10; 62-26-11; 62-2620; 62-26-21; 62-26-22; 62-26-23; 62-27-02; and 9` 6227-03 as designated by maps in the Office of the County Assessor, first Monday in March, 1863. 10! SECTION 2. The following regulations shall apply in an "A-3" District: 11 2.1 Uses permitted: I2 a. Single Family Dvellings. 13 b. General farming, horticulture, commercial-livestock, poultry production, warehouse and storage. 14 c. Accessory buildings and uses pertinent to the permitted uses, including agricultural processing plants. 15 d. Housing facilities (including trailers) to accommodate only agricultural employees and their families employed by the owner or operator l8; of the premises; and provided farther that such housing facility shall be considered accessory to the main building, but shall conform to the provision 1'7 pertaining to required yard and open space for dwella.ngs. 18 2.2 The following uses subject to securing a use permit in each case: 19 a. Golf courses-and country clubs. b. Public or.quasi-public uses including churches, firehouse, hos- 20 pitals and clinics, parks and playgrounds, schools, public utility buildings and- professional.- buildings.. 21' 2.3 r~t;niim,m Lot Area Required: Five ($) acres. 22~ SECTION 3. This Ordinance is for the purpose of orderly progress and 23 the owner of anp property zoned hereby may at any time petition the Planning Commission and the Board of Supervisors of the County. of-Butte for re-zoning; 2~ and the Planning Commission of the County of Butte shall on each fifth anni- versary of the date of the adoption of this Ordinance, of its own accord, re- 25 view said Ordinance to determine whether or not any land zoned hereby should be re-zoned to permit orderly progress. 26 SECTION 4. All uses of land within the district not specifically author- 27 lied and permitted under Section 2 are prohibited. 28 SECTION 5. Penalties for any violation of the zoning hereby imposed with- in the District shall be as provided in the Zoning Enabling_Ordinance. In 29 compliance with the provisions of the Zoning Enabling Ordinance, this Ordin- ance shall from and after its effective date become a supplement to and part 30 of the Zoning Enabling Ordinance. 31 SECTION 6.
