of B~tte, State of California, that:
1. Pursuant to §19957.5 of the Health and Safety Code of
the State o~ California, there is hereby established in the County
of Butte, a local appeals board for facilities for the physically
hand~capped, which is authorized to hear appeals regarding action
~aken by the Building Department and enforcement of the requirements
of §§~9955, et seg., of the Health and Safety Code.
2. The appeais board sha11 consist of five members who
are to be appointed by the Board of Supervisors for a term of two
years.
3. Representation on the board shall consist of two members
who are physi~ally handicapped persons, two members experienced in
construction and one member being a public member.
4. The board shall conduct hearings on wr~tten appeals
made regarding the ac~ion taken by the Building Department in
enforcement of the requirements of §§19955, et se~., of the Health
and Safety Code and may approve or disapprove interpretations and
enforcement actions taken by the Building Department. All such
approvals or dxsapprovals shall be final and conclusive as to the
Building AepartmenC zn the absence of fraud or prejudicial abuse of
dzscretion.
5. The appeals boa~d shall adopt regulations establishing
prodecural rules and criteria for carrying out of its duties.
6, All records of ~he appeais board shall be open to
inspection by the public durxng regular County office hours and
shall be kept in the office af the ~ublic Works Dxrec~ox.
