13.~2 TO THE BU~TE COUNTY PERSONNEL RULES
WHEREAS, the Board of Supervisors finds it to be in the
interest of the county tio amend the personnel rules.
~OW, THEREFORE, BE IT RESOLVED, tihe Board of Supervisars of
the County of Butte hereby amends Section 4.3(e) of the personnel
rules of the County of Butte to read as follows:
4.3{e) Discrimina~ion Comp~aints
Ar;y perso.ns filing a discrimination complaint against a
county department shall follow the procedure consisting
of the following s~eps:
Step l. Civil R~ghts Compliance Officer. If a person
believes there is reason to file a discrimination complaint
against a county department, the person may request a
confidential informal meeting with the Civil Rights Compliance
Officer within (10) ten days from the occurrence or the
person's knowledge o~ the occurrence which gives rise to
the discrimination compla~nt. ~he Civil Rights Compliance
Officer or a designated representiative shall meet with the
person within (5) five days after the request and discuss
the complaint in an effort to clarify the issue, to
investigate the compZaint, and to work towards settlement
of the complaint. The Civil Rights Compliance Officer shall
verbally present a decision to the person bringing the
discrimination complaint within (5) five days of ~he time
of the informal discussion.
Step 2. If the complaint is not resolved by the Civil Rights
Compliance Officer, it may be appealed to the Gommission.
Such an appeal shal~ be filed in writing with the Clerk of
the Com~tission w~thin (10) tien days from the time the formal
decision was rendered. ~n the written appeal, ~he appel~ant
must state the facts of the appeal and the relief requested
in sufficient de~azl to enable the Commiss~on to understand
the nature of the proceedings and parties concerned. The
Clerk of the Commission shall advise the Commission and the
appointing authori~y involved of th~ discrimination complaint
appeal. As soon as practicable thereafter, the Commission
sha11 hear the complaint and make a written decision which
shall be binding upon the county.
NOW, THEREFORE, BS I~ FURTHER RBSOLVED, the Board of
Supervisors of the County of Butte hereby adds Section 13.12 to
the personnel rules o~ the County of Butte to read as follows:
13.12 Deferred Compensation Program
The County shall establish and maintain a program whereby
employees may voluntarily authorize deferral of a portion
of ~heir wages to be inves~ed in an approved deferred
compensation plan as authorized by the Board and regulated
by applicable State and Federal law.
A Deferred Compensation Advisory Committee shall be
established consisting of (5) five members. The committee
shaZl znclude the Auditor-Controller, Personnel Director,
and County Treasurer-Tax Collector, or their designees,
and (2) two employee members nomina~ed by mutual agreement
of the recognized employee organization in the County. ~~
shall be the responsibility of the employee organizations to
establish their own procedures to resolve the nomination
issue when mutual agreement cannot be reached. The committee
may establish rules and procedures consistent with county
policy and the Plan Administrator's agreement. The committee
shall also review the application of a participating employee
to withdraw funds from the p1an. The committee, after
reviewing the application and considering special cireum-
stances, may approve or deny the reques~.
The Auditor, upan proper authorization signed by the
employee, will make payroll deductions and forward such
deductions to the Plan Administrator. The Plan Administrator,
under separate agreement, will be responsible to provide
the individual plan member and the County with periodic
repar~s of ~heir balances and earnin~s. In addition, the
P1an Administrator will provide al~ necessary accounting,
reporting and disbursement of individual member funds in
compliance w~~h the local agreement and State and Federal law.
