This Board appraves ~ha~ certain agreernent betw~en the
County o~ Butte and Cook Assaciates Consulting Engineex~s, for services
as Projec~ Engi.neer for East Ridge Assessment Dist~ic~, Coun~.y of
Butte, State af Califarnia, da~ed the. 7.4th day af Apri]. ~
1981, and attached to this resolutio~.
The Chai~man of the Board of S~pervisors is authorized to
sign the agreement and the Caunty C1.erk is authoriz~d to attest its
e~ecution.

AGREEMENT FOR ENGIN~ERING SERVICES
EAST RZDGE ASSESSMENT DISTRTCT
This xs an agreement for engineering servzces betwe~n the
Caunty of Bu~te, a pali~ical subdivision of the State of California,
refex~ed to as Client, and Cook Associates Eng~neering Consul~ants,
referred ~o as Eng~neer.
l. C~ient retains Engineer as Froject Engineer far East
~idge Assessment Distric~, County a~ Butt~, State of Ca~ifornia, ta
perform the follawing servic~s:
(a} Preparatian of a map showing ~he pxopo5ed bo~ndaries
of the assessment district, in accordance with the
requirements of Dzvision 4.5 of the Streets and H~gh-
ways Code.
(b) Preparation of the report required by Sect~on 102Q4
of the St~eets and Highways Code (Municipal ~mprovement
Act of 1913), and mod~fzcation ot the report ~~ directed
by the legis~ative bndy o~ C~ient. The zeport shall
include the ~ollowing:
(1) P~ans and specifzcations fo~ ~he proposed improvement.
(2) A general desc~aption o~ improvements to be acquired,
if any, and a lega~ description of ~ands, rights~of-
way, ea.semen~s or other interests in real property to
be acqu~red.
(3} An estimate of the cos~ of the improvement, incl~d-
ing the cost o~ acquisitions and all inczdental
expenses.
(4) An assessment diagram showing the pareels of land to
be assessed.
(5) A pzoposed assessment o~ the tota~ cos~ of the
improvement on benefited parce~s of ~and with~~ the
assessment district.
(c) Comp~lation o~ a list of the names and addresses of a11
ow~ers o~ land within the asse5sment district in accordw
ance with records of the Caunty Assessor or zn accord-
ance with tit~e reports p~avided by the C~ient.
(d) Posting of no~iees of improvement on a~l apen streets
within the assessment dis~ric~ at distances not greater
than 300 feet apart. Copies of notice of improv~ment for
posting are ~o be provided by the Cl~ent.

(e) Constxuction s~ak~ng.
(f) Attendance at mee~ings of Client's legis~ati~e bodyr
when reques~ed by Client's staff, ~or the purpose of
pr~senting and seekinq approva~ of the documents and
~eports described in subparagraphs (a) and (b).
(g) Attendance at a11 other public meetings of Client at
which matters rela~ing to the assessment di~strict are
considered, exc~pt ro~~ine matter5.
(h) Att~ndance at staff ~ee~ings oz meetings of property
owners upon req~est of ~he Client, a~ter°reasonable
notice.
(~} Telephone consu~ta~ion with staff inemb~rs and property
owners to answer engineering questions about the assess-
ment proceedings. ~
(j) ~~eparatian of change orders as may be ~equired duxing
the course o~ canstruction.
(k} Prepa~atian of a final cost schedule after campletion
o~ the improvement and paymen~ af all inc~dental
expenses.
~1) Certification ~o the Client of the contzac~or`s entitle-
ment to pragress payments.
z• The services af Engineer under this agreem~nt shall not
include the follawing:
(a) Construction inspection.
The performance by Engineer o~ services exc~uded by ~his
paragraph, if r~quired by Clien~, sha11 be under separate oral or
w~it~en agreement.
3. In consideration of the services set forth in paxagraph
1, Clien~ shall pay to Engineer the fo~lowing fee and eosts:

75~ when praceeds o~ ~he bonds are in the Client`s hands and
2~~ when the project zs accep~~d by Clien~ tor commenc~ment
af on~ yea~ maintenance period.

4. Payment by Client o~ the eng~n~ering~fee is contingent
upon the levy o~ assessments and ~he sale and de~ivery of improvement
bonds r~presenting unpaid assessments in the assessment district. If
£or any reason, assessments are not canfirmed and bonds deliv~red,
Engineer sha~l be paid no engineering fee. ,
