HomeMy WebLinkAbout81-074RESOLUTION N0. $I-74~ RESQLUTION OF INTENTION TO ORDER IMPROVEMENT IN EA~T RIDGE ASSESSMEN'~ L7TSTRTCT The Baard of Supervisors o~ ~.he County o~ Butte reso~ves: This Baard intends to order -~he fo~lowing improvement under the authority of the Municipal Tmprovement Act of ~9~3: The construc~ion of those streets named Eastridge Cour~, Oakridge Co~rt, and Rogers Ridg~ Cour~, as shown on the tract map, in accordance with Butte County Pub1~c Works Standard RS-3-B (Loca1 Access Road); ~he construc~ion o~ transitions at the intersection of Eastridg~ Court wi~h Kelly Ridge Road and at the intersection of Rogers Ridge Court wzth Heritage Road; the canstruction of an under- ground starm dra~nage system to service th~ entire tract; the construc~ion of sewer mains and sewe~ sezvice latexals stubbed to each parcel at the righ~-o~-way line, which wil~ become a part o~ the North Burbank Publ.ic Utili~y Dis~rict sewage disposal network; ~khe con.struction o~ dom~stic wat~r mains and vrater service laterals s~.ubbed ta each parce~. at the street right-of-way line, which wil~ become a pa~t of the Oroville-Wyandatte Irrigat~on District water supply network;~and the construc~ian of undergrouncl public utility facilities stubbed to each parcel at the street right-of-way ].in~, wh~ch w~11 include P. G. & E. e7.ectrical facili~ies, P. T. & T. tel.ephone facilities, and open conduit ~or future cable televis~on and street lighting tac~~.ities. This ~oazd ~inds tha~ the land specia~ly benefited by the improvement is shown within ~.he boundaries o~ the map enti~led, "Proposed Bounclaries of East Ridge Assessment District, County of Bu~~e, S~.a~.e of Ca1i~o~nia." This anap has been approved by the Board oi Supervisors. and is now on fi~.e with the County C1erk. There shall be am~tted from sgec~a~ assessment a~~ public stre~ts, a~~eys and places and a11 land be~onging to the Uni~ed States, the Stat~ of California, and this County now in use in th~ performance af a public func~ion. where any dispar~ty occurs zn ~eve~ ar size between ~he imp~ov~men~ and privat~ p~operty, this Board determin~s that it is in ~he pub~ic interest and more economical to eliminate ~he dispa~ity by doing wo~k on the private property ins~ead of adjusting the work an public property. According~y, wo~k may be don~ on private proper~y for this purpose with the written consen~ of the landowner. Serial bonds representing unpaid assessments o~ one hundred fifty dollars ($150) ar more, and b~aring in~erest at a rate no~ to exceed ten p~~cen~ (10~) per annum; wi~l be zssued in the manner pro~ vided in the Improvement Ac~ of ~9~1 ~Part 5 of D~vision 7, Streets and Highways Code}, and the Zas~ installment of the bo~ds shall mature taurteen (Z~) yea~s f~om the second day of ~anuary next succeeding the next September lst following their date. The bonds shal~ be pay- abl~ ta bearer and, shall include a redemption premium o~ ~ive percent {5~) of ~he unmatured pz~nc~pal. in case o~ default, there shall be added ta the de~aulted amaunt ~wo pe~cent (2%) of the amount thereot, and on the lst day of each month £ollowing such de~au~t, there shall be added a further penaZty a~ two percent (20) of such defaulted amount. The two percent (2.g) penalty first imposed shall be retained by ~he Treasurer as a cost of serviczng the delinquency and all subsequent penal~ies shall defaulted payment. This Board appoints C1ay Cast~eberry, Director of Pub~ic Works af the Coun~y of ~ut~e as Enginee~ af Work, and Cook Associates Consultzng Engineers, as Praject Engineer ~or this project, and directs the preparation of the report required by Sec~ion 1~2Q4 af the Streets and Highways Code. This Board int~nds to enter into an agreemen~ with Pacific Gas and Electric Company, No~th Burbank Public Utility D~strict and Orovil~e-Wyandatte Irrigatian Distric~ under ~he provisions o~ Sec~ion iai~o of ~he Streets and Highways Code, inasmuch as certain facilities ~ncluded in the imp~ovement are to be under its ownership, management and contzo~. In the opinion af this Board, the public intexest wi11 not be served by a~lawing owners of assessable lands ta enter into a con~~act for the work of improvement, as otherwise permit~ed in Sec~ian ~0502.2 of th~ St~eets and Highways Code. The amoun~ o~ any surp~us remaining in ~he impravement fund after completion of ~he impzavement and paymsnt of all e~aims sha~~ be trans~erred ta the genera~ fund if the surplus daes not~exceed the iesser o~ one tho°isand dollars {$1000} or five percen~ (5~} o~ the ~ota~ amount expended ~rom the fund.
