WHEREAS, Part d.5, of ~ivision Z, Section g9, ,Subd.ivision B, para~raph
5 0~ the Revenue and Taxation Code provides as follaws:
"In the even~. tha-t *** a jurisdic~a.onal change would
affect the servicE area or sexvice ~esponsibi~.ity of one
or more special c~i5tra.c~s, the board of su~ervisors o~ the
county or counties in wha.ch ***~he distracts are located
shall, on behalf of the da.strict or districts, negotiate any
exchaz~.ge of prope~~y tax revenues."
WI-3ER~AS, said section o~' ~he RevEi~.ue and Taxatian Code further
provides a.n ~ec~ion 99•1, Subsection (a}, paragraph. 3,
~ s'No~wi~hstanding ~he provisions of paragraph (5) af
subdiva.sioz~(b) of S~ction 99, any special dis~rict affected
by the jurisdictional change r~ay n.egotia~e on its own
behalf, if i~ so chooses."
WI~REAS, Sec~ion. 99 ~'~r~1~er provide5 in subsecta.on B, paragraph 8,
subpart (d}:
"With r~speet to ad~ustmen.ts an the a~location of praperty '
taxes pursuant to this section, a coun~y aza~ any loca~ agency
or agencies wi-~hin the coun~y may develo~ and adopt a master
praper~y -~ax transfer agreement. ~uch agreem~:;nt may be
revi~ed from time to~time by the parties sub~ect ~o such
agreement."

desire to en~er into such a master praperty tax exchange agreem~nt.
NOW, ~HERE~O~, in consideration of the premises herebefore set forth,
the paxt~es here~a agree tha~:
1. Each separate an~exa~ion fi~ing by th~ Orov~lle-Wyandotte
i, ~rriga~ian District w~ll specifically indicate a waiver of n~gotiation or a
I request for nego~iation.
2. Property tax negotiations wall be proposed an~y on those propertie
so requested ~y ~he District.
3. For aL~ o~her parcels, th~ D~strict waives ~heir rzgh~ to
negotiate with But~e County and waives thear righ~ to any proper~y ~ax from
the new~y annexed area.
~. ~h~s reso~utzon sha~l remain 3n e~fect until rescinded by the
Oroville-Wyandotte Irrigation District and until proper notice is given to
~utte Cour~~y.
