HomeMy WebLinkAbout81-109_~~ RESOL[JTION DIRECTING TRANSFER OF CERTAIN CHZZD CUSTODY AND STATUS INV~STIGATIONS FROM THE BUTTE COLTNTY DEPARTMENT OF SOCIAL WELFARE TO ~HE FAMILX CONCILIATION COURT [~TIIEREAS, the Superior Court of the State of California for the County of Butte has approved and endorsed the proposal of ~he Butte County Department of Social Welfare and the But~e County Family Conciliation Cour~ £or the transfer o~ certain child custody and status investigations from the Department of Social T~Ielfare ~o the Family Conciliation Court; and WHEREAS, the California Code of Civi1 Procedure authorizes the Family Concil.ia~ion Court to make cer~ain child custody and status investi~ations; and WHEREAS, such trans~er would be in the best interests of the County of Butte, NOW, THEREFORE, BE IT RESOLVED ~HAT: l. Pursuant to'.California Code of Civil Procedure Secta.on 1744(g), the Conciliation Counselors of the Butte County Family Conciliation Court are designated "Domestic Relations Investigators" as that term is used in California Civil Code Section 4602, £oz Che purposes ot making custody investigations and filing reports, as specitied th.erein..o 2. Pu.rsuant to California Code of Civi1 Procedure Section 17/~4(f), the Butte County Family Conciliation Cour~ is delegated those du~ies ot the probation officer specified iz~ ~he California Tdelfare and Institutions Code Section 281 regarding invesCZg;ations and reports relative to the custody, status or welfare of minors. 3. Pursuant to California Ci.viJ. Code Section 233, the Butte County Family Conciliation Court shal.7. i.nvesti~ate and report to the Court regarding the proper disposition to be made in actions brought to free children for adoption, as further speci~ied in said Section, except in those cases where the Butte County Llelfare Department is a party to the ac~ion. 4. Pursuant to California Civil Code Section 227{a), the Butte County Family Conciliation Court shall investigate and report, as specified in said Section, relating to stepparen~ adoptions. 5. Pursuant to California Code of Civi1 Procedure Section . 1744(e), the Butte County Family Conciliation Court sha11 make recommendations to the Superior Court regarding pre-age marriages. 6. Pursuant to California Civil Code Section 277(p), Butte County FamiZy Conciliation Court shall investigate and report, as specitied in said Section, relative to adult adoptions when so ardered by the Butte County Superior Court. 7. The Butte County Family Conciliation Couxt shall coordinate and be the central responsible office for znformation regarding emancipation of minors (California Code of Civil Procedure Sections 60 through 70). $. Pursuant to Cali~oznia Civil Code Section 233, the Butte County Department of Social Welfare sha11 continue ~o investi~ate and report to the Court regarding the proper disposition to be made in actions broughr ta free children for adoption who are dependents of Che Bu~re County Superior Cour~.
