' r RESOLUTION NO. 8I.=111 RESOLUT20N APPROVING REPORT AND ASSESSMENT AND ORDERING IMPROVEMENT • EAST RIDGE ASSESSMENT I]TSTRTCT The Board of Supervisors of the County of Butte resolves: This Baard has taken a ser~es of acta~ans p~e~.a,m~.nary ~a ordering th~ a.mprovement in Eas~ Ridge Assessment District, County of Butte, State of California, and now makes the fo~.~.owi~g ~~ndings and orders: 1. This Board adopted a Fnap showing the boundaries o~ the land bene~a.ted by the proposed ~.inprovement. A copy of the boundary map was f~.led in the affice of the Coun~y Recordear af the Caunty of Butte in the Book of Maps of Assessment Districtse 2, The Board adapted its xesolution of a.ntent3.on to ordez the improvament described ~herein.unde~ the Muna.c~pal ~mprovemen~ Act o~ 1913, and directed the Engineer o~ Wo~k fo~ ~he assessment district to prepare the report required by Section 102~~4 of the Stzee~s and Ha.ghways Cod~. The improvement is generally described as fo~.lows: The constructa.on of thpse s~reets named Eas~~idge Court, Oakridge Cot~.rt, arzd Rogers Ridge Co~r~, as shawn on the trac~ map, in accordanc~ with Butte County Public Works Standard RS-3-B (Loca1 Acc~ss Road}; the constxuction a~ trans~.ta.ons at ~he in~ersec~ion of Eastra.dge Court with KeZ3.y Ridge Road and at the inte~section o~ Roge~s R~dge Cou~t ~rith Heritage Road; ~he construction a~ an under- ground storrc~ drainage syst~in ta service the entire ~ract; the construction of sewer mains and sewex service ~.ateraJ.s stubbed ~o each parce]. a~ the right-af-way ~.ine, which wi11 become a part o£ th~ North B~.~bank Pub3.ic Utility Da.s~rict sewage disposa~ network; the construc~a.on of domestic water mains and water servic~: lateraZs stubbed to each parcel. at th~ s~ree~ r~.gh~-o~'-way 3.ine, wha.ch wi~l become a part of the Orovi~le-Wyaz~dotte Irrigation Dis~rict water s~pply net~,rork; and the construction of undergxound pub3.ic utili~y facilities stubb~d to each parcel at the street right-af-way line, which wil~. incltxde P. G. &~. electz~cal. ~acila.ties, P. T. & T. te~ephone ~acilita.~s, and open conduit for future -].- O WQ~ill3~.]lnl~ cable te~evisian and street lighting ~aczliti~s. 3. The~Enginee~ af Work fi~ed the report as directed, and the Board of S~pervisors ca~led a hearing on the report as required by Sect~on ~030~ of thE Streets and Highways Code. No~ice of th~ h~a~i~g was~giyen by publica~ion, by street posting and by mailing to a~~ectad praperty awners, aIl according to the Municipal Improve~ent Act of ~913. Affidavits o~ publzc~tio~~ posting and maiZing ~ere filed with the County Cle~k. ~. At ~he time and place for wh~ch natice was given, the Board o~ Supe~visors conduct~d a pub~ic hearing and gave every int~~ested person an opportunity to object to the p~oposed improv~- ment, the extent a~ the assessment dis~rict, or the pxoposed assess- ment. Following the hearing, at the.direction o~ the Board, the Engineer o~ Wo~k fz~ed an amended report. 5. The Board o~ Supervisors finds that w~itten protests against th~ proposed zmpzovement have not be~n made by owners rep~e~ senting more than one-haif o~ the az~a o~ the land to be assessed for the improvement. 6. The documents and events de~cribed in paragraphs ~ to 4, inc~usive, are stat~d here zn tabular form, wi~h ~he~z dates and, where appropr~ate, their nt~mbers. Number 81-74 81-75 7. The Board of Superviso~s apprnves the Ar~~ended Engineer's R~po~t and each component part of it, a.nclud~ng each exhibit incorpo~- ated by ~efexence in the report. 8. The Board finds tha~ the Engine~z of Work, in the Amended Engineer's Report, has faiz~.y and properZy appor~~oned ~he cost of the improvement ~o each parcel o~ Iand in the assessment da.s~rict in pro-- par~ion ta the estizna~ad benefz.fs ta be received by each pa~cel, res- pectively, from the iEnprovement. The Board hereby con~irms and levies each a.nd.a.vi.dual assessment as stated in the Amended Engin~er's Report. 9. This Board o~d~rs the irnprovement described in para- graph 2 and as detai~.ed in the Amended Enginee~'s Repor~. ~.0. Serial bonds ~epx~~senting unpaid assessments of one hundred fifty dolla~s (~1.5~) ar rnore, and bearing intex~est at a rate not ta exceed t~n percent (l0e) per annum, wil.~. be issued in the manne~r provided in the ~z~pacovement Ac't of 1.9~1 (Part 5 af Division '1, Str~ets and Hiqhways Code), and the ~ast instaZlment af the bonds shall mature fot~rteen (Z4} years fx~om the second day of January next succeed- ing the next September lst fo~.Zowing their date.
