WZTNESSETH: WHER~AS, the highway described abave has been declared ~o be a freeway by Resolu~ion ot the Calzfornia Transportation Commission an August 23, 1956; and WHEREAS, STATE and COUNTY have entered inta a F~eeway Ag~eemen~ dated December 10~ 195b~ and Supplemental Freeway Agreement da~ed October 7. 1957, re~.a~tin.g to that por~ion o~ State Hi.ghway Raute 70 from Wicks ` Co~ner ~.o Jarbo Gap; arzd WHEREAS, the Director of Transpor~ation on May 26, 198~., denorni- nated the highway described abave to be a contx'olled access highway; and WHEREAS, a revised plan map for such contral~.ed access highw'ay has been prepared showing the p~'opos~d plan of the STATE as it affects roads o~' the COUNTY; and WHEREAS, it a.s the mutual desire of the parties here~o ta enter into a new Cantralled Acc~ss Highway Agzeement in accardance with the ~evised pZan of said con~roZled access ha.gh~nray; NOW, THEREFORE, xT TS AGRE~D: 1. This Agreemen~ supersedes in i~s entixety said Freeway Agxeament dated December lb, 1956, and Supplemental Freeway Agree- ment dated October 7, 1957, 2. COUNTY agrees and consents to the clasing of COUNTY ~oads, xe~ocation a£ COUNTY raads, canstruction ot frontage roads a~d o~her local roads, and other constructian a~~ecting COUNTY roads, a11 as shown an said plan map attached hereto mark~d Exhibit A and mad~ a part hereof by this re~erence. 3. STAT~ sha~1, in construction of the cantro~led access high- way and at STATE'S expen~e, make such chan~es af£ecting COUNTY roads ~n acco~dance with the plan map attached hereto marked Exhib~t A. 4. STATE agrees ta acquire a~l necessary right of way as rnay be required for canstruction, ~econstruction, or alteration af COUNTY roads, frantage roads, and o~her local roads; and COUNTY hereby authorizes STATE ta acquire in its beha~f al~ such necessary right o~ way, 5. It ~s underst~od between ~h~ partzes that the right of way may be acquired in sectzons vr units, and that both as ta the acquisition of ~ight af way and the constxuction a~ ~he controlled access highway projects, the ob~igation~ of S~ATE hereunde~ shall be carri~d out at such time and far such unit a~ units of ~he pzaject as funds are budgeted and made lawfully avazlable for such exp~nd~tures. 6. COUNTY wi~~ accept contzol and mai~tenance over each o~ the relocated o~ xeconstructed COUNTY roads, and the fron~age roads, and other STATE con~ructed local road~ an receipt o£ wri~ten notice -z -- to COUNTY ~rom STATE that the wark hexeon has been completed, except ~ar any portion which is adopt~d by STATE as a part o~ the contro~led access h~ghway proper. COUNTY will accept tz~Ie to the portians of such roads lying outside ~he controlled access highway limits, upon relinqu~shment by STATE. 7. This Agreement supersedes the cur~en~t Freeway Ag~eement da~ed Oc~ober 7, 1957 and provzdes for an additional public road con- nection left an.d ra:ght at post mi3.c 29.75. This publ~c road access point wi~.l. se~ve the Deer Feak Lake Es~ates and was req~ested by Bu-tte County Resolution No. 78-i45. In addi.tion, the Direc~or o£ Transportation, an May 29, 19$1 approved redonomina~ing this section o~ Route 70 to a Contro~.~ed Access Hi.gY~way. The Board of Supervisors approved this action in concep~ on Ja~.uary 13, 1981. Please execute two copies o~ ~he attached Agr~ement and return them alang with a c~~ta.fied Resalut~.on ~rom ~he Baard authorizing ~the signing o~ the Agreemen~..
