Cl:~ent retains Engineer as Project Engineer for Waodridge ~anch Estates .Assessment~District, Butt~ County, CaJ.i~ fornia, to perform the~fo~l.owing services: (~.} P~epa~rati.on o~- a map showing the proposed boundar~es of the ~a.ssessznent da.str3.c~, i~ accordance with the requa.rer~ents o~ Division 4. S of the Streets and H~.gh- waXs Code.~ {b~ Prepazation of~ the report requa.red by Sectian 3.0204 of the Streets and Highways Cade (Mun.a.ciga7. Tmprove- ment Act af 1913), and modifica~ion o~ tHe r~port z~ d~x~ct~d by the legis~.ative body o~ C1.ient. (d} Posting of notices o~ ~mprovement an a~l open streets wsthin the assessment district at distances`not greater • than 3D0 feet apart.~ Copi~s of no~~ce of improvement ~ for posting are to be provided by th~ Client. (e} Construction~staking. On~ set of suarvey stakes will be set for each item of construction as requzred by the ~ speci~icatians. Restak~ng will be backchazged to the contractors. {f) Attendance at m~~tings of Client's ~.egislative body when request~d by Client's staff, for the purpose of presenting and seeking appacoval of the docu~nents and raport5 described. in subparagraphs {a} and (b). (g} Attendance at a11 other public meetings o~ CZient at wh~ch matters re~ating to ~he assessment district are consi.der.ed, except routine matters. (h} Attendance at staff ineetings or mee~ings of proper~y .. owners upon ~he ~equest of the Client, afte~ ~~ason- ~ able notzce. . (a.) Telephone co~.sulta~ion wzth sta~f inemb~rs and prQp~rty owners to answer eng~.neering quest~.ons about the assess- ~nent p~oceedi.ngs . ~ . (j) Preparation af change o~ders as may be required du~ing - the course of cons~ruction. (k) Preparat~.on of a final cast schedule after comp~et~.on of the improvem~nt and payr~-ent of al~. inc~.dental expenses. (~.} Certif~cat~.on to the Client af the C~IltZ'd.C'~Ox' ~ S entitlement to progress payments. • 2. The services of Engineer under this ag~eement shal~. not include the foZ~owing: {a) Construction inspection. The per~ormance by E~gineex o~ services exc~uded by this parag~aph, if required by Client, sha7.l be under sepa~at~ ora~ or written agreement. 3. In consideration o£ the se~vic~s set foxth in paragraph l, C~ient sha11 pay to Engineer th~ fo~~owing fee and casts: 10.2~ of the Project Cons~ruction Cost Plus Contingency. 4. Payment by C~ient of ~he enginearing fee is contingent upon the levy of assessments and the sal~e ~nd de~ivery of improvement bonds represent~ng unpaid assessments in the assessment d~strict.
