Client r~~a~.ns Engineer as Project Engineer for Lake-- a~~dge Village Assessment Distxict, Butte Caunty, California, to perform -~~-i.e fol~owing s~rvices : {a) Preparation of a map showing th~ propased boundaries o~ the assessment district, in accordance ~aith the requ~.rements o~ D.ivision 4.5 0~ the Streets and High- ways Code. (b} Prepara.tion of the xeport requixed by Section 10204 o~ the Streets and Highways Code {Municipal Ir~provement Act o~ 19Z3 ), and znod.i~~.cation of the report if dir- ected by the lega.slat3ve body o~ Client. The report sha1~. ~.nc~ude the fallowing: (1) P~ans and specifications for the proposed improvement. . (2) A general descx'ip~ion o~ imp~avemen~s ~o be acqua.red, ~~ any, and a].ega~. description of lands, rights-of-way, easements or o~her interests in rea~ praparty to be acquzred. (3) An est~.mate of th~ cost of th~ improvement, inal~d- ing ~he cost of acquisitions and all inc~dental expenses. (4) An assessment d~agram showing the parcels of land to b~ assessed. ~ {5) A proposed assessment of ~he to~a~. cost of the ~mprovement on benef i~ed parcels of land wi~hin the assessment dis~rict. (c} Compilation of a list of the names and addresses of all owners of ~.an.d within the assessment dist~ict in accord- _~,_ o~~~Q~~~~~ ance wzth records of the County Assessor or in accordance with txtle reports prov~ded by the Client. (d) Post~ng of notices of improv~nent on all open streets within the assessment distr~ct at distances not greater than 3Q0 feet apart. Copies of notice o~ imp~ovem~nt ~ for posting are to be provid~d by ~he Client. (e) Cons~ruction staking. One set of survey stakes wil~ be set for each ~tem of canstruction as requ~red by th~ specifications. Restaking wi~~ be backcharged tn the contractors. {~} Attendance at mee~ings of C~ient's ~egislative body when requested by Cli~nt's staff, for the purpose of ~ presenting and seeking app~ova~ of the documents and reports desc~ibed in subparagraphs (a}~ and (b). {g} Attendance at a~l ather public meetings of C~ien~ a~ wh~ch matters rela~ing to the assessment distr~ct are considered, except ~outine matters. {h) Attendance at staf~ meetings or ~ee~ings of praperty owners upon the reques~ of the C~ient, after reason- able notice. • (i) Telephone consultation wi~h staff inembers and propexty~ owners to answer engine~rang questions about ~he assess- ment praceedings. (j) Pr~paration of chang~ orders as may be requir~d during the caurse of construction. ~ {k} Pr~para~ion of a~ina~ cos~ sch~du~e a~ter complet~on o~ the ~mprovement and payment of all inciden~a~ expenses. (1) Certification to ~he Clien~ o~ the cantractor's entit~e- ment ~o p~og~ess payments. 2. The serv~ces of Engineer under this agreem~n~ shall not include the following: (a} Constructian inspec~ion. The pe~farmance by Engineer~o~ ~erv~ces ~xcluded by this paragraph, i~ required by C~ient, shal~ be under separa~e oral or written agreemen~. _2_ 3. In consideration of the services set~fo~~h in para- graph 1, Client sha11 pay to Engineer the fol~owing fee and costs: 12~ of the tatal cons~xuctzon cast, inc~ud~ng con~ingency allowa~ce, payable as fo~lows: 64~ upon sale of ~he bonds; . 20~ 30 days ~o~~owing issuance of notice to proceed to contrac~or; 10~ 60 days fol~owing issuance of notice to proce~d ta contrac~or; 10~ upon comp~etion of construction staking. ~ 4. Payment by Clien~ of.the engineering fee i5 con~ingent ~pon the ~evy of assessments and the sa~e and delivexy o~ improvement bonds rep~esenting unpaid ass~ssments in the assessment distric~. If for any reason, assessments are not confirmed and bonds de~zvered, E~gineer sha~l be pa~d no engineering fee.
