The purpose oY this Agreemenr is ta arrange for the Sta~e to provide Local
Agency with fire pxotection services. S~ch A~reement wil], be murval].y advantageous
to the Local~ Agency and the 5tate zn that it wi.7.1 prnvide a unified cooperative,
integrared, and etfectzve fire protection system which will satisfy the combined
Local Agency-5tate responsihili~iPS to protect 2ives, property, and na~ural.
resources from wildlait~~ fi.re damafie. .

STAT~ IN CHARGB
A. The Director will sc~~Eect and employ a Stnte Forest Officez tct represenr
both parties during the periQd af rhis Agreement and that Offzcer sa selec~ed sha11,
under the supervision and direcri.on of the Dixector or his lawful representati~e,
have charge, of ~he org;aniza~ian described in Schedeales A and 33, attached hereCa and
made a gark hereof, for the purpose of providing ~ire protection services as deemed
necessary to satis~y the needs of both the Sta~.e and o~ the Local Agency, except
upon those lands wherezn ot]ler ~gencies of government k~ave respansibi.lity far the
same or similar fire prot~ction services.
2'he State wi~l be allowed flexibility in the assignment of available
personnel. and equipmen~ zn order to pravzde the fire praCection serviees as
agreed upon herein. ~

be accomp~ished by an Amendment to this ~lgreement approved by the parties here~o.
If such a change apgl.i~s during the term o£ this Agreement but accurs or becomes
known atter the term hereaf, the Local Agency sha11. promptly reimburse State
for arty such increase ~n costs.
C. Claims shall be presenred and fi.led with Local Agency in the form and
mannex prescribed by the Local Agency.

(2) the ~ffective date a~ tez~minat~qn of this hald-over agreement f~llowing
~tate's rec~igt nf 6~ days prior written terminatian notice from Local Agency,

STATE FIR~ PRO'T~CTION 4RGANIZATIbN
' Under the requirements o€ Sectian 4114 of the Califarnia Public Resources
Code, and any other pertinent prov~sions of ~aw; the State maintains fire
prevEnt~on and fire fighting services including the necessary personn~l,apparatus,
structures, and com~t~nications as outlzned in the attached Schedule B.

LOCAL AGENCY FIRE PRQTECTION APPRQPRIAT~ONS .
Any okh~r funds appropriated by the Locai° Agency wh~eh are to be expended
under the supervision of, ar for the use of, a 5ta~e Forest Of~icer far ~ire
protection services during the ~erm of thzs AgreemenL sha3.~ be set out ~n this
Agreement and marked Schedule C. This clause shall not kimit the righr of Che
Local Agency ~o make additional expenditures whether und~r Schedule C or othersaise.
Any additional expenditur~s made by the Lacal Agency shal~ not be made for the
purposes of augmentzng,salaries of State employees, or ~n zmprov~ upon workin~
conditions for such Sta~e e~playees not mutually agreed upon. The State may~atsdit
any expenditures made under Sch~dule C, or atherwise, to verify the expenditures
were rnade for t~e purposes intended by the Local Agency.

COOPERATIV~ (IP~RATTONS
A11 fire protection wark contemp~at~d under this Agree,nent shall be
done by both partiea ~o the Agreement worki.ng as one una.t; there£ore, persor~nel
and equipment, regardless af c,rhether they are i.nc~.~ded in Schedu~.e A or B, may
be temporarzly dispatched elsevrhere from Lime to tzme for mutual azd.

Local Agency shal~ be insured against Torts ari.sing out of or occurring in the

S~LF-zNSUR.ANCE INDEMNIFTCATTON
Wa_thin any"ael~-znsured re~ention (deductib~e) of t~e insurance coverage
required nnder Sec~ian VIII and/or XVI, the Local Agancy agrees to de~end,
indemnzfy, and hold hazmless, ~he State, its empioyees, o~~icers, and aervants for
any and alI cla~ms a~d suiks aris~ng under this Agreement, except those arising out
pf the sole negligence oz wi~lful misconduc~ of the State. A certafication of
self-insurance incorparating these covenants, is inclu~ed herein on ~age ~. (If
the Loca1 Agency elec~s to be fu11y or partly self-insured, said certificataon -
must be fi~led-in and signed by an officer of the County.}

SdORKERS' CQMPENSATION
Volunteers, paid-ca11 Firemen or casual wor~ters uti~ized in local
responsibi~ity fire control by the State ~orest Officer for the purpos~s a~
preventio~ and suppression of fires shail be the responsibzlity a~ the Local
Agency for Wo~kers' Compensat~on ~n the e~ent af in~ury or d~ath. ~n the ~vent
State is assessed for th e payment of claims of said perso~s, Local Agency agrees
to indemnify State far the fu.1~ amaunt so assessed. This responsibility o€ the
Laca1 Agency for Workers' Compensation s~a11 commence from the time of th~ initial
dispatch uriti~ the volunteers, paid-ca~1 Firemen or casuai workers are reliev~d
£rom duty.

SuPPRF5SI4N C~ST RECOVERY
As provided zn Section 13009 nf the ~ealth and Sa~ety Code, the 5tate
may brzng ac~~on for Collection of suppresszon costs of any fi.re suppxessed an
State responsibilzty landa during rhe term af this Agreement. When using equipment
and personnel under ~he terms of this Agreement, ~he Sta~e may, on request of the
Loca~ Agency, bring action for col~ectzon of costs borne by the Local Agency in
which case the Local Agency appoints and designates the State as ~ts agent in said
cnilection proceedin~s. ~n the event af recovery, the State wi~l apportian to
the Loca~ Agency i~s pro-xa~a praportian of recovery, ~ess costs, including legal
~ees.

When rendering mu~ua~ aid or assi.stance as aut~ora.zed in Sectian 130~0
and 13054, Heal.th and 5afety Code, the State may, on request af the T,ocal. Ager~cy,
demand payment of cha`rges and seek reimb~rsement af Local Agency costs for personnel
as funded herei.n, under authority gi.ven by 5ection ].3051 and i3Q54, Health and
Safety Code. The State, in seeking sai.d reimhursement wi~.l represenC the LocaJ.

~roperty or equzprnent unless otherwise provi.ded £or herean or by sepaxate wxitten
agreemen~ af the parties hereto. .

PROPERTY ACCO~]NTIhG

ae to conform to t~e regulations established by the par~ies for Ll~e se~regation,
care, and use of the resp~cti~e property o~ each. .

The "o~rgartizazi.on" to be provided by State, ar~d the estimated cast of

A. All sexvi.cES and directiy re~ated expenses provided by the State €ar
t~e benefit nf the I,ocal Agency, both year 3ong and season.a~, including: 5tatie
ec{uipment, persomze~ and bu~.~.dz,ngs; the operation and maint~.nance o~ eqvipment
pravided by the Local Agency; voJ.unteEr or other ~ocal ~'ire forces and all related
expenses borne directly by the State ar-d ta be reimbursed by the Local Agency,
sha13. be shown, separate~}r. In tihe case of servi.ces provided ~ander Section 4143 and
41~i4, ~eabJ.ic Resources Code, a segaxate scn~aUi~ A, marked "A-~144", sha11 be Used
ro show the cost appartionment to be charged to the LocaJ. Agency for the use of
5tate equipm~nt, p~rsonnel and bui.~dings during the non-fire season.
B. C~rtain State fire stations, and/or thase State firrnished fire protection
activities {marked "W" an the aLtached Scheduie A) will be provided on a year round

furnished duri.ng the "period covered" indicated on ~he afnreme~tioned Schedule A.

"perind covered' and, in order to prov3.de an effective State-wide fire protecti.on
service, State ~ese~rves the righ~ ~o send, at any time, personnel and/or equi~men~
from any "W" station to an}r other locati.an as may be deemed necessary by 'State.
C. The Locai Agenc}r agrees to pay the actua~ cost of salari.es , plc~s
retirement and all other empioyee benefits, for those persannel. empiayed in
acco~dance wxth Sche.dule(s) ,A, except ~rhen "contract rates" are indicated, the rate
~1~a13. be based on ~n average salary plus all bene~~.~s. "Contract ra~es" means an

a11-inclusive rat~ covering total costs, per speca.fied position, to the 5tate for
providing 24-hour fire protection coverage during the "period covered" established
in Schedu~e A,

distribu~ion of costa sha~I comply with Section 4i44, Public Resources Code.
E. Iteimbursemen~ ~o th~ State may be pazd from any funds availabJ.~ ta the

"Local ,A~,ency--owned vehi.cles", as herea.n defined, shall ~mean any vehicles
Iisted i.n said S~hedules A and C, any other vehickea made ava~lable by the Local
Agency, but not zncluding 5tate-owned vehicles, for the performance of £ire
protec~ion services uttder thi.s Agreement. A"State-owned vehic~.e" i.s any vehicle
owned and xegistered in the name o€ the State of Califarni.a.
A. In the case of Stare-ownec~ vehicles opera~ed on behal~ of the Local
Agency and listed in Seh~dule A, the agxeed cost o~ nperaCiom sha11 inciude a3.1 costs
perta~.niz~g to running"; repairing, replacz~g, and insuri}~g the a~oresaid vetzicles.
B. Tn the case of the Loca1 Agency-awned vehicles o~erated hy the State on
behaif of the Local Agency far the agreed costs as set forth in Sched~~e A:
(I} The State shall:
a. Provade gasoline, oil, lubrication, batrexzea, tires, and tubes;
b. Repair, exchange or repiace, when necessary, motars, hoses, pumps,
spotlzghts, sirens, fire extingvi.shers, and all other accessories a~fixed to or
supplied wirh the a~oresaid vehicles when the latter were accepted by ~he S~are ~ar
operatio~~ under Schedule A; excepting €aciliti.ea or Accessories nnt common to the
use of t~te State, and radio installatians originally provided by the Local Agency.
All such equipment pravided and installed by the 5tate shall become the praperty
of t~e L<~ca1 Agency and the rep~aced equipment remaved sha~~ become the property
of ~he .State; and • ~
c. Make sueh reasonable repai.rs to sai.d v~:hic2es {but not inc~uding
pain~xng) as may be necessary to kee,p the vehic~es i.n operati:ng condition;
~rovided, however, that the State may cease to make further z~epairs on any vehicles
wY~en the State determines that the repair costa during ~.he period of this Agreement
shall exceed $10,000 £or any one ~ncident, or have exceeded the rnarke~ va~ue of
the vehicle. In the even~ the State determines that a vehicle is not fit for
turther tise because•of obsolescence or a wreck, the S[ate shall n~t be required
to repair the ve:hzc:Ee or maintai.n i.t in use. Upon such de~ermination, t1tE 5tate

C. In the case of Local Agency owned vehicles provided by Lo~al Agency,
£or perfrorsnance as contempl.ated hereunder, but r~ot included in Schedule A:
(1) The State sha].1 canform to pplzci.es a~ the Local Agency i.n operation,
use, care and mainteaance of said vehicles,
{2) The Loea]. Agency sha11 assume ~ull. responsibility fqr al.l costs
associated wi~h the acqui.sition, operat~on, use, care, maintenance and reglacement
of said vehiclea. ~ ~

D. For a1~. Loca1 Agency nwned vehicles aperated o~r used by Employees of
tkte 5~ate, under the terms of rhis Agreement, the Lacal Agency assumes full
responsibility ~or a~.l Iiabilities associated therewith and wzJ.l furnish at na
cost to.the•S~ate, evidence of motpr vehicle liability insurnnce in a form
satisfactory to the State bepartment of General Services con~aini.ng bodily injcary
liability limits of not less than $250,ooo/$soa,oao and property damage ~imits
of not Iess than $50,000 ar such highex la.mits as are specified in the ~,ocal

Wh~n a Loca1 Agency empioyee, under the supervision of the 5tate
~'orest O~ficer, operates a State-owned sutamori.ve veh~cle as a part of his dutiea
and in conneetion with fire protection services, he will be d~~:med an agent of
the BCate for acts or omissions in rhe use of such vehicle. _

This Agreement contai.ns tk-e whole contract between the parties. I~
may be terntina~ed at any t~.me or any grovision herein contained may be amended
or modified upon the mu~uai writ~en consent of the paxties hereta.
