HomeMy WebLinkAbout81-235~so~uTZON No. ~~.-z35 RESOLUTION APPROVING REPORT AND ASSESSMENT AND ORDERING IMPROVEMENT LAKERIDGE V~LLAGE ASSESSMENT DISTRICT The Board o£ Supervisors of the County of Butte resolves: This Board of Superivosrs has taken a series of act~.ons pre~iminary to ordering the improvemen~ in Lakeridge Vi~l.age Assess~nent District, Coun~y of Butte, and now makes the following findings and orders: 1. The Board of Supervisors adop~ed a map showing the boundaries of ~he land benefi~~ci by the proposed improvem~nt. A copy of ~he boundary map was filer3 in the affice of ~he County Recorder o~ the Co~nty o~ But~e in ~he Book o£ Maps of Assessment~Districts. 2. The Board o~ Sl1pE~V150~S adopted its Resolution of Tnten~ion ta ordez the ~mprovement described ~herein under the Municipal ~mprov~men~ Act of 1.913, and directed the Directox of Publi.c Warks as the Engineer of Wozk for ~he assessmen~ district, to prepare ~he zepor~ ~~quired by Sec~ion 1020~ of the Streets and Highways Code. The reso~.uti.on o£ ~ntentzon was ].ater amended. The improvemen~ is gene~al].y described a~ ~oiiow~: o~~~~~~~~. The cons~ruction of s~reets, sto~m drainage facilzties, sanitary sewers and a sys~em of domestic wa~er supp~y, together with aIl appur~enances, w~~hin the Lakeridge Village Subdivision, bounded by R~verview Drive, Hil~cres~ Avenue and Ke~ly Ridge Raad in the County of Bu~~e, State of California. 3. The Engineer ot Work filed the report as direcfed, and the Board of Supervisors ca~~ed a hearing on the report as requ~red by Sect~on I0301 of the Str~ets and Highways Code. Notxce o~ the hearing was given by f publication, by street post~ng and by mailing to af€ected property owners, a~l according to the Municipal Improvement Ac~ o~ ~9~3. Af £idavi~s of publicatian, post~ng and mailing were_£iled with the County Clerk. 4. At ~he time and place for which no~ice was given, the Board of Supervisors con~ucted a pubzic ~earing and gave every in~erested person an oppoz~unity ~o object to the proposed improvement, the extent of th~ assessmen~ d~strict, or t~e proposed assessm~n~, Fo~lowing ~he hearing, at ~he direction of the Board ot Superv~sors, the Engineer of Work ~i~ed an amendea repor~. 5. The Board o~ 5upervisors ~inds that w~it~en protes~s again~t the proposed improv~men~ have not been ma~e by owners representing ~o~e than on~-half of th~ area o£ ~he land to be assessed ~or the zmpro~ement. 2 6. ~The dacumen~s and even~s described in paragraphs I fio ~, inc~usive, are stated here in tabula~ form, with thei~ dates and, where appropriat~, their numbers. The Board of 5upervisors finds tha~ th~ Engineer of Work, in the Ainended Repor~, has fa~rly and properly apportioned the cost of ~he ~mprovernen~ ~o each parcel o~ land in the assessment dis~rict in propor~ion ~o the estimated benetits to be received by each parcel, respec~ive~y, £~om tne impro~ement. The Baar~ of Supervisors hereby confirms and ~evies each individuaL assessment as stated in ~he Amended Report. 3~ ~ _ ._._ _ _ _ ..... _ ... - ~ _~~__ 9. Th~is Soard orders ~he improvement described in pazagraph 2 and as detai~ed in the Amended Engineer's Repor~. ~0. Ser~al bonds repze~en~ing unpaid assessments of one hundred fi~~y dollars ($150) or more, and bearing interest at a rate nat to exceed ten p~rcent (10~) per annum, or such higher amount as may be permitted by state Iaw at the ~ime o~ the sale of the bonds, will ~e issued in ~ ~he manner provided in the I~provement Act of 191I {par~ 5 of Division 7, Stree~s and Highways Code}, and the last ins~allmen~ of the bonds shall ma~ure four~e~n years.~ram the second day o£ January next succeeding the next ~eptember lst following their da~e. The bonds sha~l be payable to bear~r and sha~l include a redemp~ion premium of five percen~ {5~) o~ the unmatur~d ~rincipal. 1~. According ~o Section 10603 af the Streets and Highways Code, the Board of Supervisors designates the County Treasurer to co~lect and rec~ive paymen~ of ~he assessments. Z2. The amount to be assessed against each af the parcels or subdivi~ions of land shown on the Amended Engineer's Report does not exceed 75~ of the marke~ value. of each o~ ~he properties asses5ed a~~er ~he construc~ion of zmprovemen~s; and the appraisal of ~he mar~et value of the properties to be assessed on file in ~hese proceedings is hereby adop~ed as the mark~t values of each of said pa~ce~s. ~ * ~ 4 I HEREBY CERTIFY that the foregoing resolu~~on was duly and reguZarly adopted by the Board of Supervisors of the County o£ Butte, State of California, a~ a regular meeting thereof, held on ~he 13fh day of 4ctober, 1981, by the fo~Zowing vo~e, to wit: .
