'.~lHEftE1~S, the Board of Supervisors is required by law to provide
suitable criminal justice and ~ourt faci1ities; and
4~HEREAS, the a6ility of the BoarcE to acquire, rehabilitate, construct,
finance and lease such facilities, including a11 faci1ities necessary or
incidental to the operation thereof, and to provide for the paynent or
re~ay~ent of obligations entered into for such purposes, is severely
strained by reason of limitations upon county revenues; and
4lHEP,EAS, to assist in the establishment of adequate criminal justice
facilities, Chapter 1171 of the Statutes of 1°87 provicles for the creation
of a f,r~minal Justice Facility Temporary Construction Fund (the "Fund")
and the imposition of certain surcliarges upon filings for parking,
nonparking, and all other criminal cases to be deposited into such Fund; and
IJHERFAS, the Aet becomes operative upon the adoption of a resolution
by the Board stating that the provisions of the Act are necessary to the
estab~ishment of adequate criminal justice facilities in the county,
~ursuant to Section 68073.4 of the Government Code;
Pd04d, THERFF'ORE, the Roard of Supervisors of the f,ounty of Butte
does hereby resoTve, declare and determine as follows;
7.. The foregoing recitals are adopted as a part of this Resolution.
2. Implementat~on of the provisions of Chapter 1171 of tfie Statutes
of 19~1 is necessary to the establishment of adeqUate criminal justice
facilities in the county.
3. PursUant to the Act, there is hereby estahlisherf in the county's
treasury a separate trust fund knnE:m as the P,u~te County Criminal Justice
Facility Ter~porary Construct~on Funci.
4. There shall be deposited in the Fund one dollar ($i} for each
parking case filed with the cou'rts, one dollar and fifty cents ($1.50}
for each parking ticket collected by an issuing jurisdiction, and one dollar
($1) for each ten do11ars (~10) or fraction thereof for every non-parking
fine collected by the courts, fram fines and bail forfeitures collected.
5. The moneys in the Fund sha11 6e payab1e only for the purposes
and in the manner specified in Section 68073.4 of the Government Code, as
added by Chapter 1171 of the Sta~utes of 198~.
6. The Clerk of the Board of Supervisors is instructed to transmit
a copy of this Resolution to the judges of the courts of ~his county and
to any entity within this county that processes its own parking tickets
with the request that the bail schedule amounts be increasecf as appropriate
to reflect the surcharge provided for by Sec~ion 1206.8 of the Penal Code,
effective Jenuary 1, 1982.
