NOW, THEREFORE, BE IT RESOLVED, the Board of Su~ervisors of the County of Butte hereby amends Section 2.17 of the Personnel Rules of the County of Butte to read as follows: 2.17 CO~PENSATED EMPLOYMENT Compensated employmen~ shall be limited to the following: a} wages for services performed b) vacation credit c} sick leave credit d) holidays or holiday credit e) bereavement leave f) jury duty as set forth in Section 73.6 g) paid military leave h) compensated industrial injury leave as set forth in these rules i) compensatory tima off ~or overtime worked NOW, THEREFORE, BE IT FURTWER RESOLVED, the Board of Supervisors of the County of Butte hereby amends Section 2.26 of the Personnel Rules of tne County of Butte to read as fiolZows: 2.26 DISCRIMINATIOIV Any action against a person by reason of race, nationa7 origin, politics, reliqion, age, sex, marital status or handicap which denies such person equal employment opportunity. N06J, THEREFQRE, BE IT FURTNER RESO~VED, the Board of Supervisors of the County of Butte hereby amends Section 2.53 of the Personnel Rules of the County of Butte to read as follows: 2.53 PROVISION~L APPOINTME~T The appointment to a regular budgeted position when no eligible list exists of a person who meets the minimum qual~fications of the position for a period of time not to exceed (6) six months in duration or (60) sixty days following the establishment of an eligi6ili~y list for the position, whichever ~s less. NOW, THEREFORE, BE IT FURTHER RESOLVED, the Board of Supervisors of the County of Butte hereby amends Section 2.65 of the Personnel Rules of the County of Butte to read as follows: 2.65 VOLUNTARY DEMOTION The voluntary movement either within a department or between county departments of a regular employee from one class of position to another class of position, with a 1esser salary range, for which the employee is qualified. NOW, TN~REFORE, BE IT FURTNER RESOLVED, the Soard of Supervisars of the County of Butte hereby amends Section 4.1 of the Personnel Rules of the County of Butte to read as fol1ows: 4.1 PURPOSE Butte County supports the concept of Affirmative Action and Equa7 Employment Opportunity in the public service as consistent with merit system principles. Tfie county wi17 consider all applicants and employees on the basis of qualificat~ons and potential, without regard to race, national origi~, po1itics, religion, age, sex, marital status or handicap. Acceptance of these principles does not end with the prohibitfon of discriminatory practices. The county establishes as its goal the development of a practical plan for specific steps to be taken to achieve and maintain equal oppartunity in county emp7oyment. This plan includes positive efforts in recruitment, examination, se1ectTOn, promotion, pay, traini~g and appea~ procedures to insure that members of protected groups are provided opportunity consistent with merit principles to achieve positions in county employment and promotional opportunities at all job classificatfon Tevels. NOW, THEREFORE, BE IT FURTHER RESOLVE~, the Board of Supervisors of the County of Butte hereby amends Sect~on 6.2 of the Personnel Rules of the County of Butte to read as fo1Tows: 6.2 APPLICATIQN FOR EXAMINATION A separate application must 6e submitted for each examination. The application must be submitted during the a~nounced recruitmen~ per~od on a standard county application form. The applicatian form must be completed in sufficient detail to allow a job-related comprehensive rev~ew and evaluation of the applicant's quali~ications. Fai7ure to f~le the application during the recruitment period or to complete the ap~lication in sufficient detail w~ll const~tute failure of the init~al step in the examination process and the application wi17 be placed in the inactive files. It is the appTicant's responsibi7ity to notify the Personnel Directar of any change of address, name or other pertinent informatian. Veterans of the United States Armed Forces who have served contfnuously on active duty for 180 days or more and who have been honorably discharged or placed on inactive status sha11 be eligible for five (5) veterans' preference points to be added to a passing score of an open, non-promotional examination. Qualified veterans with a service-connected disability af 30% or more shall be eligible for an additional five po~nts to be added to a passing score of an open, non-promotional examination. To receive veterans' preference points, each eligible veteran shall submit to the Personnel Director during the announced recruitment period for each specific open, non-promotional examination a wri~ten request for veterans` preference and written proof of eiigibility. The Persannel pirector sha71 be responsible to estab7ish rules, procedures and forms necessary to carry out the provisions of this section. - 2- ~OW, THEREFORE, BE IT FURTHER RESOLVED, the Board of Supervisors of the County of Butte hereby a~ends Sect~on 6.8(i) of the Personnel Rules of the County of Butte to read as foilows: 6.8 ELIGIBLE LISTS i. Re-emp7oyment Lists. The Personnel Director sha~l estab1ish a re-empioyment list for each class in which a layoff occurs. Such 7~sts shall contain the names of permanent employees who have been laid off or demoted in 1ieu of ~ayoff. Names of persons laid off or demoted in lieu of layofif sha1T be p7aced on the appropriate re-employment list in the inverse order of separation, the most senior first. Names on the re-employment 7ist sha31 be automatically removed upon the expiration of (18) eighteen months. Names o~ the re-employment 7ist shall be removed for any of the reasons set forth in these ru7es. NOW, TMEREFORE, BE IT FURTHER RESOLVED, the Board of Supervisors of the County of 8utte hereby amends Section 6.10(c) and ~h) of the Personnel Rules of the County of Butte to read as follows: 6.10 APPflINTMENTS c. Extra He1p. An appointing authority may make an extra-help appo~ntment when an appropria~ion for extra help has been authorized. The notice of appointment sha7i be sent to the Personnel Director for approval prior to the extra-help worker commencing work activities. Any person emp7oyed for extra-help work shall meet the minimum qua7if~cations for the position corresponding ~o ~he duties of work ass9gned. ~xtra-help workers shall be employed at the min~mum hourly rate for the class of assignment. Extra-help appointments shali normally be made at the lowest paid class ~n the series appiicable to the work to be performed. Extra-help appointments shali not exceed (12) twe7ve mon~hs in any ~24) twenty-four consecutive month period, except that the Personne~ Director may approve appointments not to exceed (18) eighteen months for speciai projects. h. Re-empioyment. Upon recommendation of an appointing authority and with the approval of the Personnel Qirector, an emp7oyee separated in good standing from county employment may within (3) three years of the separation date, be re-employed in a class in which the eroployee held permanent status or a class w9th the same or lower salary range for which the former employee is qualified as determined by the Personnel Director. An employee re-emp7oyed under the provisions of this section shal7 serve a probationary period in the class in which the re-employment occurs. When a vacancy in a department occurs, an appointing authority shall consider any re-employment request or consider such request in addit~on to an e7igibility list for the position, except that no re-employment shall occur in a classification where a 7ayoff re-employment list exists. NOW, THEREFOR~, BE IT FURTHER RESOLVED, the Board of Supervisors of the County of Butte hereby amends Section 7.2 of the Personnel Rules of the County of Butte to read as ~ollows: -3- 7.2 PROBATIONARY PERIOQ QF NEW ~MPLOYEES All new regular employees shall serve a(6} six month probationary period except that employees appointed to the classification of Deputy Sheriff shall serve a(12) ~welve month probationary per9od. Employees appointed to positions of Jailer and Bailiff after October l, 1977, shall serve a{1) one year probationary period. During the probatianary period the appointing authority shal7 observe the employee's performance. If the appointing authority rejects the employee at any ti~e during t~e probationary period, the appointing authority shall, in writing, inform ~he employee and the Personnel Director. The employee shall then be terminated. Except for allegations of discriminat~on raised pursuant to rule 4.1 of these rules, employees shall have no right to appea7 a rejection during the probationary period. If, at the end of the probationary period, the appointing authority believes the employee is performing satisfactorily, the appointing authority shall, in writing, inform the emp~oyee and the Personnel Director and the employee shall be granted permanent status and may enjoy such privileges which are set forth in these rules. Should the appointing authority fail to perform the emptoyee's probationary review at the end of the probationary period, the employee shall automaticaily be granted permanent status. A provisional employee, in a class who is subsequently appointed to that class as a probationary employee without break in service, shall ~ave the time served as a provisianal emplayee applied to fa~fil~ment of the required probationary periad. NOW, THEREFORE, BE IT FURTHER RESOLUED, the Board of Supervisors of the County of Butte hereby amends Section 7.4 of the Personne7 Rules of the Cou~ty of Butte to read as follows: 7.4 PROBATIO~ARY PERIOD OF DEMO7E~ EMPLOYEES An employee who is demoted for disciplinary purposes,~shal3 serve a probationary period in the new class unless the employee previousiy held permane~t status in that class or a higher class in the same class series. An employee who voluntarily demotes to a lower classification shail not be required to serve a new probationary period provided the employee held permanent status at the lower class level. Empioyees who voluntarily demote whi7e on probation must complete the probationary ~eriod in the lower classification. NOW, THEREFORE, BE IT FURTHER RESOLVE~, the Board of Supervisors of the County of Butte hereby amends Section 7.10 of the Personnel Ru7es of the County of Butte to read as follows: 7.10 PROMOTION A~D VOLUNTARY Q~MOTIOPJ The Personnel Director and appointing autharities shall inform emplvyees of opportunities for promotion to more responsible positions in the merit system. Al1 employees in the classified service shall be entitled to necessary time off with ~ay for the purpose of taking qualifying or promotional examinations cond~cted by the Personnel Director. Satisfactory performance for the county sha11 be an important corosideration in reviewing qualifications of an applicant certified on an eligibility 3~st for promotion. A regular employee may request a voluntary demotion to any vacant position within the county merit system for which the employee meets the minimum qualifications. Upon a recommendation of the appointing aathority and the approval of the Personnel Director a voluntary demotion request shall be authorized. The Personnel Director shall establish forms and procedures for the purpose af carrying out the provisions of this sect~on. -4- NOW, THEREFORE, BE IT EURTHER RESOLVED, the Board of Supervisors of the County of B~tte hereby amends Section 7.i3 of the Personnel Rules of the County of But~e to read as follows: 7.~3 LAYOFF An appointinn authority may initiate a 7ayoff for a regular-help position{s) d~e to administrative reorganization, lack of work or appropriat~on. The Personnel Director sha73 estabiish a seniority list and shaTl consider length of service and efficiency in determining which employee or employees are to be laid off. NOW, THEREFORE, BE IT FURTHER RESOLVED, ~he Board of Supervisors of the County of B~tte hereby amends Section 7.14(a) and (b) of the Personnel Rules of the County of Butte to read as follows: 7.14 SENIORITY LIST SCORE COMPUTATION a. Regular-help employees appointed to a position with Butte Coun~y shall receive credit for compensated regular-help employment that has not been broken by a permanent separation. When there has been a permanent separation, credit shall be given only for regularThelp employment fo7iowing such break in service. The seniority status accrued by those incumbent employees in the Welfare, Health and C7vi7 D~saster Departments under the Local Agency Personnel Standards prior to August 7, 1976 shall remain on accrual. b. One point seniority credit shall be given for each calendar month ofi regular-help employment or any portion thereof excluding extended leaves of absence. Regu7ar employees working part-time schedules will be given fractional point credit for each month of service on a prorata basis. NQW, THEREFORE, BE IT FURTHER RESOLVED, the Board of Supervisors of the County of Butte hereby amends Section 7.18 of the Personnel Rules of the County of Butte ~o read as follows: 7.18 LAYOFF REINSTATEMENT Permanent employees laid off who are reinstated to a regular county position within (18) eighteen months from the effective date of layoff, shall be reinstated with seniority r~ghts. Such emp7oyees sha1i be credited with unused sick ~eave on accrual at the time of layoff up to a maximum of (30) thirty work days and shall accrue vacation benefits at the rate established by prior seniority. An emp7oyee reinstated to the same classification in which permanent status was held at the time of layoff shall no~ be required to serve a new probationary period. A former e~ployee re~employed in a classification with an equal or lower pay range ~han that held by the employee at the time of 7ayoff, pursuant to the provisions of these rules, shall remain on the valid re-employment lis~. Should an employee on a layoff list be re-employed by the county in a classification w~th a higher pay range than that held at the time of layoff, the employae`s name shall automatically be removed from the layoff re-employment list upon comp7etion of the probationary period. -5- NOW, THERE~ORE, BE IT FURTHER RESOLUED, the Board of Supervisors of the County of Butte hereby amends Section 1~.2(h} of the Personnel Rules of the County of Butte to read as follows: 11.2 FILING OF RECOGNITTON PETITION BY EMPLOYEE ORGANIZATI~N h. A statement that the employee organization has no restriction on membership based on race, national origin, politics, religion, age, sex, marital status or handicap. NOW, THEREFORE, BE FT FURTHER RESOLVED, the Board of Supervisors of the County of Butte hereby a~ends Section 12.6 of the Personnel Ruies of t~e County of Butte to read as fo17ows: 72.6 MERIT ADVANCEMENT WITHIN RANGE a. Perfortnance Report Required An appo9nting authority shall review a regu7ar employee's performance to determine whether or not the emp~oyee should rece9ve a merit advancement within the sa~ary range. This determination shall be noted on a performance evaTaation form and together with an action form be forwarded to the Personnel Director. b. Period of Employment Required for Merit Advancement Unless otherwise specified in these rules, each employee shall, in addit~on to the required performance standards, complete the fol7owing required time in regular-help status to be e7igible to rece9ve a merit increase. 1. New Employees A person h~red as a new county employee shall have a merit advancement date which is (1) one year fallowing ~he appointment date. 2. Promotion or Demotion An emp7oyee who is promoted or demoted shall have a~erit advancement date wh9ch shall be (1) one year from the date of promotion or demotion. 3. Transfer or Vo7untary Demotion An empToyee who transfersor who voluntarily demotes to a class of position at a lower salary range shall have no change in merit adva~cement date. 4. Change in Range Allocation If the salary range for an employee's c7ass is changed, the emplayee`s merit advancemen~ date shall not change. 5. Position Rec1assification a. An employee whose position is reclassified to a classification having the same or a Zower sa1ary range shall have no change in meri~ advancement date. b. An employee whose position is reclassified to a classification hav9ng a higher salary range shall have a merit advancement date which is (1) one year follow~ng the effective date of the position reclassification. -6- 6. Step Adjustments An employee whose sa7ary step is ad3usted to a higher step ~ithin the salary range shall have a merit advancement date effective (1) one year from the date of adjustment. c. Effective Date When an e~ployee's merit advancement date falls in the first week of a pay period, the employee's merit increase sha17 ~ake place on the first day of ~hat pay period. When an employee's merit advancement falls in the second week of the pay period, the employee's merit increase will take place on the first day of the next pay period. An appointing authority may delay the effective date of a merit advancement up to (90} nine~y days beyond the employee's merit advancement date without affecting the emp7oyee's normal merit advancement date. In case of such delay, the employee's merit advancement shall be effective the first day of the pay period following the approval of the appointing authority. If a merit advancement is delayed beyond (90) ninety days from the employee's merit advancement date, the emptoyee shall not be eTigible for merit increase unti7 the empioyee's next normal merit advancement date. d. Regu~ar Part-Time Employees For the purpose of th~s section regular part-time employees shall be considered in full-time service and shall be eligible for merit increases at the time prescribed. NOW, THEREFORE, BE IT ~URTHER RESOLVED, the Board of Supervisors of the County of Butte hereby amends Section 73.70(e) of the Personnel Rules of the County of Butte to read as follows: 13.T0 TRAVE~ AND EXP~NS e. Expenses for Mileage Any off~cer or employee who has received authorization to use a privately-owned vehicle for county bus9ness sha11 be reimbursed at a rate of (25} twenty-five cents for each mile driven o~ county business duri~g the month. Any officer or emp7oyee, except Board and Commission members specified in these rules, who during any month is authorized and provides a privately-owned vehicle for county use in excess of (5) five working days during the month shall receive ($25) twenty-five dollars ~or the firs~ (100) one-hundred mi7es or portion thereof of miles traveled on county b~siness. Such officers and employees shall receive in addition after the first (700) one-hundred miles per month, (25) twenty-five cents a mi7e for all other miles traveTed on eounty business during the month. The County Administrative Officer sha17 develop rules and procedures for the aathorization of vehicle use under this section.
