GIHEREAS, Proposirion ~ of 1979, the "Spirit of Yroposztion
13", amended Che State Constitution adding Areicle XIII B, Section 6
to require the State Legislature to provide a subvention of funds to
reimburse lo~al governmenC whenever iC mandates a new program or
higher level of service; and
wHEKEAS, Proposition 4 beca~~e operative on Ju1q 1, 1980,
and the various state Iegislative conforming statutes became operative
on January 1, 1981; and
WHEREAS, in 1981, the Legislature knowingly passed numerous
bills with a state-~andated local program but failed to fnclude a
subvention of funds to reimburse local government for those mandates;
and
WHEREAS, the Legislature in uiost cases was informed by
both its own state financial advisors as well as local government
financial specialists that these bills contained state-mandated
costs; and
WHEREAS, a representative group of county counsels and
chief administra~ive officers are reviewing al~ 1981 chaptered
legislation that does not provide an appropria~ion and has identified
c~iaptered sta~~tes which mandat~ an increased cost on county government;
and
~HEREAS, the proposed new program or increased level of
service is not at issue; rather at issue is the Leg~slaCuxe's
unconstitutional failure to provide funding; and
WHEREAS, these 19$1 chaptered bi11s are intended to become
operative on January l, 1982;

NOW, THEREFORE, BE IT RESOLVED that the ~utte County Board
of Supervisors supports the County Supervisors Associaeion of
California's position that those I981 chaptered bills which do not
comply with Article XIiI ~, Section 6 of the Consitution (Proposition
4 of 1979) should not be implemented on January i, 1982; and
BE IT FDRTHER RESOLVED that a copy of this resolution be
provided to the Honorable Edmund G. Brown, Governor; the Honorable
Ray Johnson, State Senator; the Honorable Stan Statham and Wally
Herger, State Assemblymen.

Baard Action R~garding ~nconstitutiona~ State Legislative
Mandates," I am enc7osing a list af twenty-5even bi11s passed
during i981 tha~ do no~ appear ~o fully cflmply with ~he state
constitution. T~is list was deve1oped by a committee a~ county
caunsels and caunty administrative officers at the request of
the CSAC Board of D~rec~ars.
The list of twenty-seven b~~~s was selected fron mor~ than 12~
pieces af leqislation passed in 1981 by ~he state Legislature
that probab7y do not f~lly comp1y with Article XTII B, Sec~ion b
~Gan~ 5pending Lim~tat~on~ af ~he state constitution. This list
will be fur~her reviewed y the co~nty counsels and CROs ~or
6oth their legal and financial i~pact. A final report will be
SUa~i~~~d t0 the CSAC Execut~ve Corr~ittee at its ~ecember 11, 1981
meet~~g in San Francisco. This report will be forwarded to your
county`s representativ~ on the CSAC Board of Directors.
I~ the meantime, you may wish to review this list of bil~s wi~h
your county counse1 and administrative staff. We hope your board
of supervisars wi11 meet in advance af the CSAC Baard o~ Directors'
~~eting on December 18 to give gu~dance to yaur representative on
that CSAC Board.

se~ected for r~corrgne~datian to GSAC. The Cou~ty Counsels' Comml~tee identif~ed
27 1981 bills which it feels may be approprlate for tes~ing the constitutiona~ity
of the State Leg~slatures con~inued d~sregard for the constitu~iona~ requireme~t
to provide a subvent~on of funds when adopting s~ate-mandated 7oca~ programs. 3his

a violation of the rrovisions a.n Proposition 4.
I agree tha~ tha~s is a sPrious prob~em and ~eel ~hat the rpcent
court action ~aken by the Count_y Su~erva.sars ~ssociation i.s prabably
justified. I am particularly hope~u~. that thA court action will
force mv coll.eagues here in th~ Leqislatur~ to be more carPful
and discrim,znati.ng when in'troducing and votinr~ on m~asures i~hich
aff.ect local governments. It would be especiaZlx effective if the
result of ~.he court action was a re-orderinq of }~riarities so that
the state would be ~.ess eaqer to inter~'ere and intexvene in the
affa~.rs o£ locai governments.

this wi31 not change. I have little daubt that a~]. too many of
