ON PETITION TO ABANDON RQADWAY
WHEREAS, this Board has received a petition from Scott
Lawrence and oChers requesting the abandonment of a roadway as
described below; and
WHEREAS, pursuant to Chapter 3, Part 3 of Division 9 of
California Streets and H~g~ways Code, this Board sha11 set a date
for a hearing on the petztion for abandonment,
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors:
1. That thzs Board hereby gives notice that at its regular
meeting on February 9 , 1982 at 10:00 a.m., in the Board Chambers,
Sutte County Administration Building, Oroville, California, a hearing
sha11 be held on ttae abandonment of the ~ollowing described roadway:
Being an 80 foot public right of way lying within a
portion of Section 8, T18N, R4E,.MDM, as shown on
that certain map called "Town of Palermo" recorded
on Wall Map No. 3, Maps of Record, County of Butte,
State of California, being more particularly
described as follows:
Being all that 30 faoe righC of way known as Hewitt
Avenue, lying between Block 23 on the west, Block 34
on the east, bounded on the north by the southerly
ra.ght of way line of William Avenue and on the south
by the northerly right of way line of Ludlum Avenue.
EXCEPTING AND RESERVING any existing easements and/or
rights at any time, or ~rom time to time, to maintain,
operate, replace, remove, renew and enlarge the
existing public utility facilities and facilities
incidental thereto, including access to protect the
property from all hazards in, upon, and over the
highway hetewith abondoned.
Reserving to Pacafic Gas and Electric Company for
service to the general public the right from time
to time to install, mainCain, operate, renew and
use such overhead electric facilities as it may
deem necesary over, along and within said abandoned
portion of Hewitt ,Avenue.
2. That a map showing said portion of said roadway to be
abandoned is on file at the Public Works Department, 7 County Center
Drive, Oroville, California.
3. That this Resolution be posted and published pursuant
to the provisions of Chapter 3, Part 3 of Division 9 of Cali€ornia
Streets and Highways Code.
