HomeMy WebLinkAbout82-013RESOLUTIQN OF THE COUNTY OF BUTTE ANNEXING TEI2RITORY TO COUNTY SERVICE AREA NO. 23 (PLEASANT VAI,I,EY DRAINAGE DISTRICT) WHEREAS, Fish Ranch Investors have petitioned the Loc:al Agc:ncy Formation Commission for inclusion within the Pleasant Val~ey Drainage District; and WHEREA5, the Butte County Local Agency Forma~ion Cor~mission has approved this annexation and designated zt: 81-13 CSA ~23 Pleasant Va11ey Drainage Annexation - Foothill Park Units 2, 3, & 4; the ex~erior boundaries of which are described in Exhibit "A" attached hereto axid made a part hereof by this reference; and WHEREAS, the Bu~te County Local Agency Formation Commission has duly approved and authorized the Board of Supervisors to annex such territory without notice and hearing by the Board and without an election; and WHEREAS, the territory is uninhabited; and WHEhEAS, the reason for this annexation petition is to provide storm drainage; and WHEREAS, the Ci~y of Chico has heretofore filed with this Board their consent that a portion of tlte city may be included within the boundaries of County Service krea No. 23. NOW, THER:,'FORE, BE IT RESOLVED that the terri~ory described in Exhibit "A" designated as 81-13 CSA #23 Pleasant Valley Drainage Annexation - Foothill Park Units 2, 3, & 4; is h=reby annexed to and included within the boundaries of County Service Area No. 23 ~Pleasant Va7.].ey Drainage). BE TT ~'[1RTHER T2E,50LVED that said ~erri~ory shall be t~ed to pay any andebtedness or liabi~.ity of County Service Area No. 23 ~Pleasant Valley Drainage) prior to or existing at the time of annexation. BE IT FURTHER RESOLVED that said territory shall. pay $555•12 to Butte County for drainage area per acre assessments as a condition of this annexation. ~E I~ k'[1RTHER RESOLVED that ~he app7.icant's engineer is to de~ermine whether ~he current storm drainage system has adequate capacity or needs upgrading; this determina~ion must be checked and approved by the County. Upgrading of the storm drain system wi11 be tota3.J.y at ~he appli.cant's expense.
