HomeMy WebLinkAbout82-015~:_~ This matter came on regularly for hearing before the Board of Supervisors of the County of Butte, State of California, on January_19 _~ Z982, in the Board Chambers, Butte County Adminiseration Building, Oroville, California, and it appearing to said Board thaC a NotiCe of Time and Place of Hearing of said Abandonmenr was duly and regularly given as required by law, and Cestimony and evidence, both oral and documenCary, having been produced at said hearing, from which said Board now finds thaC the hereinafter desctibed Pub~.ic Utility Easement and Re~reational Ease- ment is unnecessary for present or prospec~ive public use. " NOW, THEREFORE, IT IS HEREBY ORDERED as follows: 1. Thati rhe public ueility easement and recreational ease- menr si~ua~ed in the County of Butte, State of California, as herein- afrer more parricularly described is hereby abandoned. 2. That the description of said public utility easement and recreationai easement so abandoned is situated in the County of Bu~te, State of Cali~ornia, and more particularly described as follows: PPCC l, LOTS 63, THROUGH 74 AND LOTS 95 THROUGH 112 Being that certain 20-foot public utility easement and recreational easement and that certain 10-foot public utility easement and recreational easement and those certain five-foot public utility easements lying within a portion of Section 36, T23N, R3E, MDM, also being a portion of Lots 63 through 74 and Lots 95 through 112, as shown on the map of Paraciise Pines Country Club Estates Unit l, recorded in Book 38 Maps of Record at Pages 57 through 60, County of Butte, State of California, being more particularly described as follows: 1. Being that certain 20-foot public utility easement and recreational easement lying 10-feet on each side of and parallel with the lot line that runs between Lots a,, 63 through 74 and Lots 95 through 108, beginning at Che ~ most so€~therly corner of said Lot 63; thence N 30°29'23"W ~ 223.99 feet; thence N 66°28'36"W 367.98 feet; ~hence N 55°21'32"W 176.04 feet; thence 44°10"44"C~, 172.42 feet; ~ thence N 19°02'16"W 72.24 feet; thence N 23°45'18"E ~ 111.91 feet, excepting therefrom the 20 feet lying ~~"-, within the 20-foot setback line. "' ~ ~ RESOLUTION ABANDONING A PUBLIC UTILITY EASEMENT AND RECREATIONAL EASEMENT 2. Being that certain 10-foot public utility easement and recr~ational easement lying westerly of and para~lel with the easterly lot line of Lots 109 through 112, beginning at the southeasterly corner of said Lot 112; thence N 35°04'26"E 138.51 feet; thence N 16°37'S1"E, I20:32 feet; thence N 10°46'06"W 149.68 feet to the corner common to Lots 63 and 109. 3. Being those certain five-foot public utility easements lying cont~guous to all side iot lines, excepting therefrom the portions of said easements lying within the 20-foot setback line. Sazd Map of Paradise Pines Country Club Estates Unit 1 is on file in the Butte County Depar~ment of Public works, 7 County Center Drive, Orovi~le, Galifornia. 3. That the Clerk of this Board shall cause a certified copy of this Resolution, with the seal of the Board of Supervisors of the County of Butte, State of California, to be recorded in the office of the Recorder of the County of Butte, State of California.
