TO THE RULE OF JOINT AND SEVERAL LIABILiTY
WHEREAS, the Tort Claims Acr of 1963 declares that the subject
of governmental tort iiabi~ity sha~1 be entirely controlled by statute;
and
WHEREAS, the Tort Claims Act has been substantially changed by
recent case law; and
WHEREAS, the rule of joint and several liability as declared
by the California Supreme Court in American Motorcycle vs. Superior
Court has imposed liabzlity upon defendants regardless of the comparative
degree of fault and has made eac~ defendant an insurer of the other;
and
WHEREAS, the rule of joint and several liability is znconsistent
with the prznczple of comparative negligence adopted by the California
Supreme Court in the 1975 Case of Li vs. Yellow Cab and is the principal
reason public entities have become "target" and "deep pocket" de£endants;
and
WHER~AS, Che rule of joint and several liability has placed a
tremendous financial burden upon public agencies, because of the
increased numbet of claims and increased settlement and judgment cosrs;
and
WH~REAS, all such increased costs are paid by the general
public from tax revenues decreased by Proposition 13 azad limiCed by
Proposition 4; and
WHEREAS, SS 1336 proposes to fai.rly apportion liability based
upon the comparative degree of fault, thereby limiting the expenditure
of public funds ro the share of a judgment equal ro such agency's
proportionate share of liability;
NOW, THEREF'ORE, BE IT RESOLVED by the Butte co~nty Board of
Supervisors on behalf of the taxpayers of the Countq of Butte, urges
the Californa.a Legislarure and the Governor to enac~ SB 1336 ciuring
the 1981-82 General Legislative Session; and

BE IT FURTHER RESOLVED, that copies of this resolution be sent
to ~he Governor, the Senate a~d Assembly Judicxary Connmieeees, the
Legislativ~ delegates representing Butte Coun~y, and the County
Supervisors Association of California.

An act to add Section 817 to the Government Code, relating
to liability.
LEGISLATIVE COUNSEL'S DIGEST
SB 1336, as introduced, Davis. Comparative faul~: public
entities. ~
Under existing law, iri an action based upon neglig~nce or
praduct liability against multiple tortfeasors for an indivisible
injury, ~he tort£easors, incl~ding any public employee or
public entity tortfeasors, are jointly and severally liable ta the
plaintiff for all compensable damages attributable to that.
injury except for damages attributable to the negligence of
~he plaintiff. However, a tortfeasor who pays more than his or
her equitable amount of damages may s~ek equitable
indemnity fro~ other ~or~feasors.
- This biil would provide that in an action for personal injury,
prope:rty darnag~, ar wrongful dea~h, wher~ an individual
injury is the proximate result of the wrongful conduct o~ 2 or
more p~rsons, at least 1 of which is a public entity or public
ernployec~, damages wauld be apportioned among the
tortfeasors, and the public employee and public entity
tortfeasor wouFd be liable for only the percentage of the
damages allocateci to it, and a s~parate judgment wo~ld be
~ reridered far that amoun~. The liabiiity of the public entity
and public employee would be several, and ~he liabzlity of
nonpubIic entity tor~feasors would be joint and several with
regard ta the damages not attributable to the public entity or
pub~ic employe~. Howeve:r, liability for an int~ntiona~ injury
would be for all compensable injuries. The bill wauld make
relatc~d changes.
