Home My WebLink About82-025RESOLUTION RELATIVE TO MILITARY SPOUSE RETIREMENT WHEREAS, the economzc plight of the farmer spouses af ret~red membe~s of the Armed For~es of ~he United Sta~es, who are predominantly wame~, is a s~rious problem requzring legislative remedy; and WHEREAS, legisla~ian has been introduced in both the Unit~d States Senate and House of Rep~esentatxves to address ~his issue; and WHEREAS, ~he provisions o~ law re~ating to the annual appropriation o~ federal monies to fully f~nd the ~ilitary non- disabi~ity retirement system requzres the review o~ the Congress of the Uni~ed States as it p~rtains to the exemption of these benefzts ~rom community property laws; and WHER~AS, there are p~e~eden~s which establis~ tha~ cer~ain ~ormer spouses have a vested interest in f~deral retirement benefits (Czvzl Service Re~irement Law, P~blic Law 95-366; Fareign Services Act of 1980, ~ublic Law 96-~fi5); and WHEREAS, without a change in federal law, the loss of supplemental incame benefits, medical benefits, and suitable housing faczlities resulting from a change zn ~ariCa~ s~a~us wi~~ ~orce the former spouses of inembers flf the Armed ~o~ces who are witho~t marke~able jab skills ta seek public aid or relzef; and WHEREAS, ~he Board of Supervisors of the County of Bu~Ce, S~ate of Ca~ifornia, supports the right af these former spouses o~ members of the Armed Forces of the Unit~d States to an equi~abl.e shaxe of the military ret~remen~ benefits of their forme~ spouses. of the County of Bu~te, 5~a~e of Califo~nia, respectfu~~y requests the ~~eszdent and the Congress of the United States ~a enact legislat~on providi~g for the paymen~ of a share of the military retirement o~ a member or former m~mber af the Armed Forces af the Uni~ed Sta~es to his or her foxmer spouse on ~he terms set forth in a court order or court-approved property settlement agreemen~ znCidenC to any dec~ee o~ dissolutzon of marriage, annu~ment, or legal separation; and BE IT FURTHER RESOLVED ~ha~ rhe Clerk of rhe ~oard of Supervisars transmzt copzes of this resolution to the President and Vzce-President af the Dnited States, to the 5p~aker af the House of Represen~a~ives, ~o ~he Chazrman af the House Armed Services Committee, to the Chairman o~ the Senate Armed Services committee, and to eaeh Senator and Represen~a~ive fram California z~ the Congress of the United States.
