RESOLUTION APPROVING AMENDED AGREEMENT FOR ENGTNEERING SERVTCES
SACRAMENTQ AVENUE ASSESSMENT DISTRICT N0. 1
The Board of Supervisors of ~he County o~ Butte resolves:
This Board appraves that certain am~nded agreement between
the Co~nty of Butte and McCain Associates for s~rv~ces as Engineer
of Wo~k for Sacramento Avenue Assessment Dis~rict No. ~, Butte Coun~y,
~982
Ca~.i~ornia, dated the ~~ day of _~ph~„ar~, .~~~~ and a~-
tached to this resolution.
The Chairman o~ the Board is authorized to sign the agreement
and ~the County Clerk is authorized to attest its execution.

SACRAMENTO AVENUE ASSESSMENT DISTRICT NO. 1
This is an agreement for engineez~ng service5 betwe~n
the COUNTY OF BUTTE, a po~itical subdivisxon o£ the 5tate of Ca~i~ornia,
referred to as Cl~en~, and McCATN ASSOCIATES, referred ~o as Engineer.
~. Client retains Engineer as Engineer af Wark for Sacra-
mento Avenue Assessment Distxict No. ~, Butte Coun~y, California, to
perforin~the fallowing service5:
(~) Prepa~ation o~ a map showing the praposed boundaries of
the assessment d~strict, in accardance with ~he require-
rinents of Division ~.5 of the Streets an:d Highways Code.
{b) Prepa~ation of the repart requized by Section 1.0204 0~ the
Streets and Highways Code (Municipa~ Improvement Act o~
19I3), and ~nodification of ~he repo~t if directed by the
~.egi.slative body of Clien~t. The r~port shal.l inc~.ude
the following:
(~.} Plans and specifications ~or the proposed imp~'ovement.
. {2) A general. description of improveFnents to be acquired,
if any, and a legay description of lands, r~gh~s--of-
way, easements or other int~rests in ~'eal p~oper~ty to
' be acquired.
{ 3) An estimate of the co st of the improverr-ent, inc].uding
the cost of acquis~~ions and all incidental. expenses.
(4} An ass~ssment diagrain showing the parcels of land to
be asses5ed.
(5) A proposed assess~ent o~ the tota~, cost af the im-
provement on benef~.ted paxc~l.s af land within th~
assessment distzict.
~ (c) Compila~ion of a~ist of the names and addresses of
all owners of land within the assessment distr~.ct in
acco~dance with z~ecords of the Coun~y Assessor or in
accordance with ti~~.e repor~s pravid~d by ~he Clien~.
'. (d) Pos~ing o~ no~xces o~ improvemen~ on al~ open streets
~ within the assessment dis~rict at distances not greater
. than 300 feet apar~. Copies of notic~ of impzovement
for posting are to be pzov~d~d by the C~ient.

cextifieation to the Client of the contrac~or's entitle-

- when requested by,Cl~.ent's sta~f, for the purpose at
presenting and seeking approval o~ the documents and
reports descrzbed in subparagraphs (a) through (d).
(h ) Attendance at all othe~ pub~.ic rneetings o£ C~.a.en~ at
• which matters relating to the assessment distriet are
conszdered, except routine mat~ers.
(i) Attendance at sta~f ineetings a~ meet,ings of property
' ~ owners upon the request of the C3.ien~, a~~er reasonable
• notice. ~ .
(~) Te~.ephone consultation with staff inembers and property
owner~ to answer eng~.neering questions about the assess-
ment proceedings.
Qc) Px'epara~ion of change o~d~rs as may be required during
the course af construction,
t~ ? Prepara~ion of a~~.nal cos-~ schedule after cornpletion
of the improvement and paymen~ o~ all incidEn~.al expense.,
(m ) Appraisa]. and right--of~-way acquisit~.on services. ~
2. The services o~ Engineer under ~h~.s agreement shall not
inc~ude th~ following:
(a) Preparation of an environ~ental assessment, ta dete~nine
whether the improvement wi~1 have a signifa~cant impact
on the environmen~ wzthin ~he zr-eaning a~ tne Ca7.iforn~a
Env.iror3mental Qual.ity Ac~.
(b) Px~paration o~ an En~crironmen~al Tmpac~ Repor~
3. ~n consideration o~ ~.he services se~ for~h in Paragraph l,
Client shalZ pay to Eng.znee~ the following ~ee and costs:
Standard Hour~.y Charges, as set forth and shown on Exnibit A
a~tached to this agreemen~, wh~.ch saxd Exhibit A is, by
~his re~erence, xncorporated he~ein, provided that the aggre-
gate tota]. of a~l charges does no~ exceed $~~0-0~0.00.

In no event, how~ver, wi~l the compensatian of Engineer exceed
$~20,000.00 unless and until all other costs and expenses charge-
able against the improvement ~und ~or Sacramento Avenue Assess~
ment Dzs~rict No. 1 have been paid or provisian has been made
~or thezr payment.
4. The compensation o~ Second Party he~einabove set forth
shall be dete~-rnined in acco~dance with Exhibi~ A attached hereto,
and said sum shaZl be charg~d to and paid only ~ro~ ~he incidental
~Kp~ri5~5 for said assessment district and ~rom no other source
or fund except that i~ ~he eve~t First Party does not proceed
wi~h this assessment distric~ proceeding past the hearing on the
Resal~~ion o~ ~ntention, then C~ient shall pay Enginee~ ~n accord-
ance with said Exh~bit A fram funds other than the inc~dental
expenses for said assessment district, not to exceed One Hundred
Thousand DolLars•($1~0,OQ0.00).
