HomeMy WebLinkAbout82-087RESOLUTION OF SHE BOARD OF SUPERVISORS ESTASLISHING 7HE COUNTY CRI~INAL JUSTICE FACILITY TEMPORRRY CONSTRUCTTO~ ~U~d WHEREAS, the Board of Supervisors is required by law to provide suitable crim~nal justice and court fac9lities; and WHEREAS, the ability of the Board ~o acquire, rehabilitate, construct, f~nance and lease such facilities, including all fac~lit3es necessary or incidental to the operation thereof, and to prov9de for the payment or repayment of obiigations entered into for such purposes, is severely strained by reason of limitations upon county revenues; and WH~REAS, to assist in the establishment of adequate criminal justice facilities, Chapter 1171 of the Statutes of 1981 provides for the creation of a Criminal Justice Facility Temporary Constructio~ Fund (the "Fund") and the imposition of certain sureharges upon filings for parking, nanparking, and a11 other criminal cases to be deposited into such Fund; and WHEREAS, the Act becomes operative upon the adoption of a resolution by the Board stating that the prov9sions of the Act are necessary to the establishment of adequate criminai justice facilities in the county, pursuant to Section 68073.4 of the Government Code; NOW, THEREFORE, the Board of Supervisors af the County of Butte does hereby resolve, declare and determine as fo11aws: ]. The foregoing recitals are adopted as a par~ of this Resolut~on. 2. Implementation of the provisions of Chapter 1171 of the Statutes of T981 is necessary to the estabiishment of adequate crimjnal justice facilit~es in the county. 3. Pursuant to the Act, there is hereby estab9zshed in the caunty's treasury a separate trust fund known as the Butte County Criminal Justice Facili~y Temparary Construction Fund. 4. There sha71 be deposited in the Fund one dollar ($1) for each parking case filed with the courts, one dollar and fifty cents ($1.50) for each parking ticket collected by an iss~ing jurisdiction, and one dollar ($1) for each ten do~lars ($10} or fraction thereof for every non-par~ing fine collected by the courts, from fines and bai7 forfeitures collected. 5. The moneys in the Fund shall be payable o~7y for the purposes and in the manner specified in Section 68073.4 of the Government Code, as added by Chapter 1171 of the Statutes of 1981. 6.
