interest of the county to amend the Personnel Rules.
NOW, THEREFORE, SE IT RESOLVED, the Board of Supervisors
af the County of Butte hereby amends Section 12.14(j) of the
Personnet Ruies of the Coanty of Butte to read as fo3lows:
j. Exempt Employees
The overtime provisions of this sec~ion shall not
apply to management, confidential or supervisory
positions as de~ined in these ru~es.
Except as provided, an incumbent in a position
defined as management, confidential or supervisory,
shall receive administrative leave in 7ieu of paid
overtime. Adm~nistrative ]eave in lieu of paid overtime
shall be accumulated at a rate of 0.1538 days for each
bi-week7y period of compensated service. Administra~ive
leave may be accumu7ated to a maximum of (40) forty
days. Employees who termina~e from the co~nty in
good standing sha71 be compensated for any administrative
leave accrued under tfiis sect9on, up to the maximum
accrued amount.
Incumben~s in positions defined as management, confidentiai
or supervfsory, who prior to December 24, 1977 were
eligible for the paid overtime provisions of these
rules, shall continue to be eligibie to receive
overtime pay ar compensatory time. Such incumbent
may, through written mutual agreement w3th the appointing
authority and approval of the Personnel Director,
convert from the overtime provisions of these rules
to the in-lieu administrative leave pravisions.
Once such agreement ~s reached, it shall not be reversibie
for the posit3on. Whenever a management, confidential
or supervisory position for which the compensated
overtime provisions apply becomes vacant, the position
shali be identif~ed as one to rece~ve administrative
7eave in lieu of overtime before the position is
refilled. Whenever a new management, confidential or
supervisory position is created or designated pursuant
to these rules, it shall be exempt from overtime
provisions of these rules and the in-lieu administrative
leave practices shail apply to the position.

Supervisors of the County of Butte hereby amends Section 13.5{a)
of the Personnel Rules of the County of Butte to read as follows:
73.5 HOLIDAY LEAVE
Designated Holidays
Each regular employee in a compensated employment
status on the assigned work day immediately
preceding and the assigned work day immediately
fol7owing a designated holiday sha11 be entitled
to campensation for the designated hoiiday.
The following ho1idays are designated:
1) New Year's Day January 1
2) Washington`s Birthday Third Monday in February
3) Memorial Day Last Monday in P1ay

required to work on a designated holiday ar whose
regular scheduled day off fa71s on a designated
holiday shall at the discretion of the appointing
autharity be entitled to either equivalent compensated
time off schedu7ed the day preceding the designated
holiday or within (60) sixty days following the
designated ho1iday or equivalent compensation to
be paid within (60) sixty days fol7owing the
designated ho1iday.
Regular employees exempt from paid overtime shall
be entitled to compensation for designated holidays
actually worked. Extra-help employees shall
no~ be entitled tv paid holidays or compensated
time off for holidays warked.

Th~s Memarandum represents the good ~'a~th effort on both the
County and the E~r~it representa~~ves to reach agreemen~ on matters
of wages, hours and cor~ditians of emplayment. I~ is ur~derstoad
tha~t this agree~en~ ~s not b~nd~r~g ~pon the Coun~y unti7 s~ch
time as it ~s rati~ied ~y the Sutte County Board of Supervisars
and ~~e membersh~p of the Unit. Tt is agreed as follows:

1.01 f~ANAGENiENT RTGHTS.
The Co~n~y reserves all rights wi~h respec~ ta matters a~ ger~eral
~egislative and mar~ag~riai policy including, among others, t~e
~xclus~ve righ~ ~o determine the~mission of ~ts co~stituent
departments, commiss~ons and boards; set s~andards of service;
de~ermine the procedures and standards af sel~ction ~For emp7oyment;
direct its emp~oyees; ~ake disc~plinary action; relieve its ~mp~oyees
of duties because af lack of warlc or ~'or other legitimate reasor~s;
ma~nta-in the ~ff~ciency of gaverr~mental operat7ons; de~ermine
~he methods, means and persanr~e7 by which governmental operations
are to be conducted; take all necessary actians to carry out ~ts
r~iss~on in emergencies; and exercis~ camplete contro1 ar~d discret~an
over ~ts organ~za~ion and tk~e technoiagy of performing its warfc.
TE~ese rights sf~all be lim~ted only as specified in this agreement.
~.02 RECOG~ITION.
The Coun~y recognizes the Bu~~e CoUnty Management, Conftdent~ai
a~d 5upervisory Unit as t~e exciusive repres~ntative far emp~oy~es
designated in ~he Manage~e~t, Confidentiai and Supervisory Unit
of county ~mp7oyee5 pursuant to 5ectio~ 3501b of the Califor~ia
Gover~ment Code and ~he County Employer/Employ~e Relations Po7icy
set for~h i~ Chapter Z1 of the Butte County Personnel Ru7es.
Such des~gnated classif7ca~ions and pos~tions are attached her~to
as Ap~endix "A".
1.03 U~I~ SECURITY.
Ti~e Un7~ shall be prov~ded payroll deduction for r~em~ership d~es.
7he Un~t sha11 ~rovide the County Auditar with a wr~tten author~zation
~n a form approved by the County signed by ~he unit member authoriz7ng
the payral~ deduction and setting for~h the fu17 amount to be
deducted each month. The County sha17, through t~e Auditor's O~f~ce,
forward in a~~r~ely manner payro7l deductions withheid from employees
wi~h~r~ the unit. The flnit sha3i ~mm~diately na~ify ~~e Aud3tor of
any cance7lation or changes i~ the deduction aut~orizations.
The Court~y sha71 not be liable to the E~r~~t, employees ~r any
other party by reasan of th~s sect3ar~ for the rem~ttance ar payment
o~ any sum other than ~I~e actua~ deduct~ons ma~e fram the empioyee's
paycheck. The Unit sha~l save the County harm1ess against ar~y and
a13 clair~s, d~mar~ds, sui~s, orders, 3udgments, or o~her forms of
~iabil~ty that may ar7se out af or by reasan of actian taken by
.the emp7oyer under this sectian.
3.04 USE OF CO(~NTY FACILITIES A~[D RESOURC~S.
With t}~e appraval o~ the Caunty Rdministrative Off~cer or other
County authorized official, the Unit r~ay use certain County facilit7es,
resources ar~d supp~ies as long as the Cour~ty is reimbursed for
the cost of any supp1~es or mater~als provided ~o ~he llnit and that
s~ach use or supp~y does r~at interfere w~th the e#~iciency, safety
and security a~F Coun~y operatians.. The County sha11 prov~de a
~ist of ath~r officia3s autf~orized to permit lJnit usage of County
faci1it~es, resa~rces and suppl~es.
The Unit agrees to pay the Coun~y upon demand from ti~e Aud~tor, costs
a~ such b~nef~ts ar supplies rece3v~d from the County, incl~ded but
not iimited to se~^v-~ces of Coun~y-owned or ~eased Xerox or other

copying machines, pr~~t shap reproductian ~aci~~t3es, and cen~ra7
services purchases for expendib~e of~3ce suppl~es for U~it use.
7.05 BULLETIN BdARDS.
The llnit shall be provided reasonable ~esignated space an CoUnty
bu~let~n boards whtch does not ~nterfere with ~he Coun~y's officia~
use of ~he bulletin baard.
7.06 ACC~SS TO EMPLQYE~S.
With pr~or notice to the faci~ity manager, the Unit or its
officia37y desig~ated representatives may have access to County
employees ~uring off-duty time in the non-work areas of County
~aci~~ties far the purpose of Unit busjness.
7.07 INFORMA7ION TO UNIT.
The County agrees to provide the Unit annua~ly dur~ng the month
of ~an~ary a complete updated 3isting of the name, classification
and departm~n~ of assignment of a~7 employ~es designated in the
unit. The Co~nty a1so agr~es to pravide on a month1y bas~s t~e
na~e, classification, date of appaintme~t and department assigned
of ai7 new emplayees hired ~nto t~e uni~.
In the event of a~ayoff ~n classes represented by the Un~t,
t~e Unit shall be provided with a copy of the resul~ing reWemplayment
~ist(s).

The County sha11 g~ve notice to the Un~t of any ~ew classificatian
propased to be inc~uded in this Memora~dum. Upan request, the County
shall have a~ leas~ two mee~ and canfer sess~ons with the Unit for
~he purpose of negotiating wages for such classifica~ion. When
meet~~g and con~errtng pursuant to this sect~an, the Unit's
representat~ves shall be limite~ to ~aid staf~ or one officer
of t~e Un~t and one Uni~ represen~at~ve des~gnated by the ~ntt
~or each cZassification pro~ased to be added.

~he ~nit shall 6e a3~owed to designate ~p to two (2) emp~oyees
wit~in the Unit to serve as represen~atives to negotiate with
the Coun~y. T~e Uni~ shai~ pravide the Personrel Director with
the name, classification and depar~ment ass3gned af each o~ the
negotiators.
Shou1d any change or a7ternates be appoin~ed af~er the or3gina7
~ist is es~abi~s~ed, ~he Un~t sha1l advise the Personn~l Director
i~mediate1y. Empioyees designated as Uni~ ~egot~ators sha~l,

2.01 WORK SCHEDULES.
The normaT work schedul~ sha31 be 8:00 a.m. ta 5:a0 p.m. eac~
day of the year excep~ Saturdays, 5undays and ho7tdays. The
nor~ai work per~od sha17 be SQ hours per b~-weekly pay period
for a full-time employee. Except ~or over~ime, cal7back and
standby assignments, de~ar~me~ts which necess~tate a different
op~ratio~al schedule shali maintain and past an employee
ass7gnment schedule. No emp~oyee, excep~ in case af emergency,
sha11 be required to work a dif~erent work schedule ~han assigned
u~less the e~ployee has been notif~ed at 7east ten (1~) days
in advance of the change in wark schedule.
2.02 SCHEDULE AD~US~M~NT L~AVE.
E~fect3ve Avgust i8, 1982, ~nit emp~aYe~s wi~~ no longer accrue
Schedu7e Adjustment Leave. Saiary ranges in e~fect per
Ordina~c~ 2252 shai7 continue unchanged, reflecting co~pensation
for an 80whour pay period schedu1e, rather than a 75-ho~r pay
period sc~edule. Employees having accr~ed Schedule Rdjus~m~nt Leave
whi ch they earned pri or to Augus t 18, ~ 982 sha7 ~ be allowed to taEce the t~

aff ~n accordanee with Section 8.02 af the ~981-82 Memorandum
of ~nderstanding.
It is understood and agreed tha~ 5ection 8.03 af the 19$~-82
Memorandum of ~~ders~a~ding, "Buy Out of Schedule Adjus~ment
Leave" is cance7led as a resu~~ o~ ~h~s agreement.
2.Q~ FURLOUGH RULE.
Far the term of ~h~s agreem~nt, it is unders~ood a~d agreed
that ~~e Caunty, upon de~ermYnation of a f~scal cris~s, sha11
affer to mee~ and confer with the U~it to consider fur~ough ot
employees in 13eu of layoffs. ~uring periods of fur7ou~~,
employees shai~ be consi~ered ta be on ~on-compensated ieav~,
except tha~ emp7oyee benefit accruais sha11 co~tinue as if the
employee was working. Fur7ough periods sha11 not be cons~~~red
to be ttme wor~ed for ~~e purpose of comput~ng overtime.
ExcePt when required by public safety, heal~h or iaw, furioughs
sha11 be accamplished by closing ofifices. The County will consult
w~~~ the Un~t prior to invoking the Fur7augh Rule withaut closing
o~~ices, ~n arder to explain t~e reasons therefore. Employees
shal~ receive wr~~ten notice af furlough at ~east ten (10} ca3endar
days prior ta ~he e~~ec~ive date of the ~urlo~gh. Only one not~ce
need be g~ven ~~ the furlough is to follow a specific sc~eduie.
T~e appl~cation af the Furlough Rule shail not be su6ject ~o ~~e
grievanc~ ar appeai process.
2.04 SPECIAL VACATIQN ENTITL~MENT.
Effec~ive January 1 0~ any year, ail current emplayees sha7~
be credi~ed with three {3) da.ys of vacatzon. Emp1oye~s hired
betwee~ January 1 and April 30 sha11 be credited with two (2}
days of vacation. ~mp7oyees hired between May 7 and August 31
s~a11 be credited with one {1) day o~ vacation. 7~ese days sha71
be added to the emp~oyees' regu7ar vacation earnings and the accrua7
7imits increased accordingly. The special vaca~ion entitlement
~s in l~eu of the persona~ holidays in ~he Perso~nel Rules,
Sec~ion 13.5~b}. .

2.05 VACA~ION CARRYDVER RULE
When a Uni~ emp~oyee ~s unab~e to take scheduled vacatian during
a calendar year due to unusua7 and extenua~ing depart~ental needs
wh~ch r~s~3t i~ the empioyee's annual vacation accrual to exceed
the maximum limt~s auth~rized, ~he department head sha11 advise
the Audi~or that ~he emp7oyee w~11 exceed ~he annual vaca~ion accrual
l~mits and shal~ sc~eduTe ~he excess accrual vacat7an days to be
taken aff ~etween t~e period of Jan~ary 1 a~d March 31 of the new
ca~e~dar year. 5hould the emp7oyee va7untari7y c~oose not to
take the sched~7ed vacat~on during the extensia~ per~ad, the
excess accrual days shali be for~eited. Should a department head,
as a resu1t of em~rgency needs of the Co~n~y, be unab~e to sched~ie
t~e excess accrual vacation days of~ dur~ng the exte~sion p~riod,
t~e emp~oyee shali be paid for t~e excess accrua1 vacation days.
2.06 MATERNITY LEAVE. (Fema7e)
~r~ployees sha1~ be granted a 7eave ot absence for pregnancy not
to excee~ four ca~endar months upon presentation of proof of
pregnancy. The non-compensated portior~ of such leave sha11 no~
be granted ur~der this section until the emp~oyee has exhau.sted
sick ~eave, vacation and compensatory tir~e o~f ~eave balances
but may be ex~ended by mutuai agreement of the employee and tt~e
Coun~y. The County may require reasonable proo~ af tf~e emp~oyee's
abi~~ty to return to work.
2.07 STAND-BY PAY.
(a} Status
~ach employee in the unit of represer~ta~ion shal~
be entitled to receive ~15.00 far each 8-haur s~and-by
~- shi~t, or portion thereof as ordered ar~d authorized by
an appointing authorlty. A stand-6y sh~ft is defined as
~ ar~y 8-F~our shi#t following the em~~oyee's normal ass~gned
'shift.

authority or des~gnee advised o~ their loca~ian during the
stand-by SFIi~'~ and shal~ respond to d~~y withirt twa {2)

When an appoi~ting authority determines 7t is ~n the
interes~ of the Caunty to provide electranic paging
devices far sta~d-by workers, the appq~nt~ng author~~y
s~al~ pravide and mainta~n such dev~ces and instr~ct
warkers in the proper use.
Employees on stand-by status sha17 not be el~gib7e for
shift dtf~erentia7 pay as specified under 5ection 12.17,
or for call-back pay as specified under Sec~ion 1Z.74~~)
af the Personnel Ru~es. Non-exempt employees re~~rning
to du~y from stand-by shai7 be eligible ~or overtime as
sp~cified in Sect~on 12.14 af the Personnel Ru7es.
2.0.8 TEMPORARY ASSIGNME~T TO A HIGHER PA~D CLASSIFICATTON.
Whenever an emp~oyee is assigned ~n writing by the depar~ment
head to work in a higher c7assification and there~ore per~arms
subs~ant~ally all af the duties of t~e h~gher c~ass~ficationfor
a period of more than twe~ve {72) cumulative warking days i~ a
fiscal year, the employee shail be en~itled to be compensat~d
with an additiona7 five percent (5%} over his/her curr~nt rate
af pay beginning w~th the th~rteenth (73th) day of ass~gnmen~.
2.09 HEALTH PLAN PREMIUMS.
Commencing September 1, 1982 v~s~on care shall be eiiminated and
aut-pa~~ent, diagnost~c, x-ray and labora~ary transferred from
the basic to major m~dical por~~an of the P~an. 7he ~oi1owing
rates shall ~hen apply and ~hese rates sha~1 remain in e~~ect
through June 30, 1983:

2.10 EXTENDED BEREAVEM~N~ LEAYE.
In addi~ion to ~he ber~avement leave be~efit set for~h in
Sect~on 33.3 of the B~tte County Rersonnel Rules, a regular employee
who believ~es it necessary tfl be absen~ from duty because of t~e
~~ath of a member a~ the~em~layee's immediate fami~y who resided
oUt of ~he State of Ca~ifornia, may have an add7tional two days
o~ ber~aveme~t leave to be charged ~v sick leave.
2.i1 SPECIAL HQLiDAY LEAVE.
Each regular empioyee in a compensated employment sta~us o~ ~he
assigned work day im~ed~a~e7y preceding, and the assigned work
day ~mmediately fo1iowing, the employee's b~~rthday shall be
ent~tied ta a bir~hday ho~iday. An appointing authority may
require an employee ~a provzde faurteen (14} days notice in
advance of the birthday ho7iday. Birthday holidays sha~~ be
ca~sidered as a des~gna~ed hoiiday pursuant to Section 13.~
of the Personne~ Rules.
2.12 SICK LEAVE 8~Y BACK 4PTION,
On retirement or termination in gaod standi~g, an emplayee who
~as on accr~al more than thirty (30) work days o~ sick ~eave
may be compensated for ~~at portion over th~rty (30'} days at
one-half (1/2} ~he norma~ rate of pay ~or ~he empiayee up to
a maximum ot $i,500. For ~mp7oyees wha hav~ on accrual 100
to 750 sick ~eave days, the maximum reimbursement sha71 be
$1,70~. Far thDS@ em~loyees w~o have on accrua~ ov~r 15Q days,
~he maximu~ reimb~rsement shali be $2,Q00.
2.13 PROF~SSIONAL DEYELOPMEN~ AND TRAT~ING.
7he County Personnel pirec~or wi71 p~ovide a training progra~ for
~anagement, Confidentia~ and Supervisory employees ~o ~mprave
ski~~s and knowledge in suc~ areas as employee supervision,
perfor~ance, evaluation, non-discriminatory selection, warkers'
compensa~ion and unemp7oyment ~nsurance processes, discip1ine and
emp1oyee relations. The County sha1~ set aside $3,OOQ to cover
the costs of such trainin~ during this contract year. ~

A cammittee sha~l be estab1ished consist~ng of the Personnel
Director and two Uni~ representat~ves to ~eterm3ne the number
of emp7ayees wi~h~n ~he Unit who are requ~red by Zaw ta possess
and mai~ta~n a va~id state 7icense nr cer~ificate as a prerequisite
ta ~he~r posf~ion. T~e commit~ee sha1~ then deveiop a plan
t~at wou3d provide far the county to re~mburse s~ch emp7oyees
for a71 ar a port~on of such 7ic~nse or certificate ~ees. The
Coun~y shall establish a budget ~ot to exceed $2,000 to cover
the cost of the program the cfl~mit~ee develops ~or th~s contract
year.

and other ~erms and cor~di~ions of empiaymen~ not covered by
~his Niemorand~m of Un~erstanding shali rema~n ~he same ~For the
~ term of th~s ~{emorandum of Understanding. There~'ore, excep~
by rr~~t~a7 agr~ement of the parties or as spec~fically provided
o~herwise herein, for the T~fe o~F ~h-is Memorandum of Understanding
neither party shall ~e compe7led ta bargain w~th the other
concernTng any mandatory barga~n~ng issue whe~her or not ~he
1S5L~2 was s~ec~fica7ly barga~ned prior to the execut~an o~
this Niemoran~um of Understanding.
3.02 ~~VACTME[~T.
This MemQrandum of Understanding shall become effective when
rat~fied by the Lln1t's m~mbership and adopted by Reso1u~ion of
~he But~e County Board of Superv7sors. Upan such adoptior~
~he provis~ons of this Memorandum sha~l supersede and controi
over conf7icting or inconsistent County Ord~nanc~s, Resolu~ions
or Rules.
3.03 SAVI~fGS CLAUS£.
If any prov~ sior~ of tli3 5 Mer~orandum sha~ 1 be hel d i nval id
by operation of 7aw or by ar~y co~r~ of compe~en~ juris~~c~ion,
or if comp~iance w~th ar enforc~ment af any provision sha~l
be restra~ned by any tribunal, the rema~nder of this Memorandum
of Unders~anding shall not be affected ~Y~ereby, and the parties
sha~l en~er ~nto negatia~ions for th~ sole p~rpase of arriving
at a mutua~ly satisfac~ory rep~acemen~ for such provis~on or
provisions.

The part~es to ~his l~er~arandum of ~nderstandir~g recognize and
acknowledge that the services performed by County employees
covered by th~s agreement are essential to the public heal~h,
safety and g~neral welfare of the residents of the Cour~~y of
Bu~te. The Unit agre~s that under no c~rcumstances wi71 the tlnit

recommend, encourage or caUSe its memb~rs ~o init~ate, part3cipate
in, ~or wili any member of the bargaining u~it take part in
any str~ke, si~down, stay-i~, sick-out, refusa~ to work over~ime,
slow daw~ or picket~ng (~erein co7lectiveiy referred to as a
work stoppage}, i~ any offiice or depar~ment of ~he Coun~y, nor
to curta~7 any work or restrict any production, or ~n~erfere
wi~h any ap~ratio~ of ~he County. In ~he event of any such
work s~appage by any member of the bargain~ng un~t, the County
shall no~ ~e requ7red to nego~tate on the merits of a~y dispute
which may have given ~ise to such work stoppage until the work
stop~age has ceased. ~
In the ~vent of any work stoppage dur~ng the term of this
Memorandum a~ Understanding, whe~~er by the Unit or by any
~ember of ~he bargaining uni~, the ~n~~ by its afficers, shall
immediateiy declare in writing a~d pubiicize ~~at s~ch work
stoppage is i71~ga1 and una~t~orized and further direct its
members ~n writing to cease said canduct and resume wark. Gapies
of such wr~tten notice shall be served upon ~he County. If in
the event of any work s~oppage the ~ni~ prom~t1y and in good fait~
performs the obl~gatlons af t~is paragraph, and providing that
~he Unit has nat otherwise aut~oriz~d, permitted or encouraged
such wark stoppage, the Unit sha~~ nat be 17able for damages
caused by the vio~ation o~ this provis~an; however, ~he County
shaiT have the r~g~t ~o discipline, to inc~ude discharge, any
employee who instigates, ~artic~pates i~, or gives 7eadership
to, any work stappage activity, herein prahibi~ed, a~d the County
sha~i also ~ave the right to seek fu71 iegal redress ~ncluding
damages aga~nst the employee.

Th~s Memorandum of Understanding is entered inta between
the County of Bu~~e and the But~e County Managemen~, Confidential
and Superv~sory Unit. This M~morandum sets forth the ~erms
and co~di~ions estab7ishing the strategy and commitment with
regard to the FY 8~ Meet and Confer process and bene~i~s.
l. Far ~~scal Year 84 all i~ems will be o~en for
discussion ~nder the Mee~ and Con~er process.
2. The County agrees that no wage or hours reductions
will be requested during the FY 84 Meet and Con~er
session.
3. Effective July 2, 1983, the Caunty agrees.~to
pay fully the employees' cont.ributian ~owards the
Pu~1ic ~mpioyees' Retirement System.
