ESTABLISHING THE COUNTY CRTMINAL JUSTICE
FACILITY TEMPOkZARY CONSTREJCTION FUND
WHEREAS, the Board o£ Supervisors is required by law to
provide suitable criminal justice and court facilities; and
WHEREAS, the ability of the Board Co acquire, rehabilitate,
construct, finance and lease such facilities, including all facilities
necessary or incidenkal ta the operation thereof, and to provide for
the payment or repayment of obligations entered into ~or such purposes,
is severely strained bq reason of limitations upon county revenues; and
WHEREAS, to assist in the establishment of adequate criminai
justice facilities, Section 68073.4 of the Government Code and Section
1206.8 of the Penal COde provide for the creation of a Criminal Justice
Facility Temporary Construction Fund (the "Fund"), and the imposition
of certain surcharges upon filings for parking, nonpatking, and all
other criminal cases to be deposited into such fund; and
WHEREAS, Sec~ion 5$073.4 of the Government Code and
Section 1206.8 of the Penal Code become operative upon the adopCion
of a resolution by the Board stating that these laws are necessary
to the establishment of adequate criminal justice facilities in the
county;
NOW, THEREFORE, the Board of Supervisors of the County of
Bu~~e does hereby resolve, declare and deter~ine as follows:
1. The foregoing recitals are adopted as a part of
this Resolution.
2. implementation of the provisions of Section 68073.4 of
the Government Code and Section 1206.8 of the Pena3. Code are necessary
to the establishment of adequate crfminal justice facilities in the
county.

3.' Pursuant to these laws, there is heteby established
in the county's treasury a separate trust fund known as the Butte
County Criminal Justice Facility Temporary Construction Fund.
4. There shall be deposited in the Fund one do11aL ($1.00)
for each parking case presented to or filed with the courts, one dollar
and fifty cents ($1.50) for each bail deposit collected or each bail
violation which is not filed in couLt, as set forth in Government Code
Section 68073.4(b), co~lected by an issuing juxisdiction, and one
dollar ($1.00) for each ten dollars {$10.00) ox fraction thereof
for every non-parking fine collected by the courts, as authorized
pu~suant to Penal Code Section 1206.8(a)(2).
5. The Clerk of the Board of Supervisors is instructed
to transmit a copy of this Resolution to the judges of the courts of
th~s county and to any entity within this county that processes its
own parking tickets with the request that the bail schedule amounts
be increased as appropriate to re€lect the suTCharge prov~ded for by
Section 1206.8(a)(2) of the Penal Code effective
