PARADTSE BLUFFS ASSES5MENT DISTRICT N0. 1

resolves:
,This Board intends to order the fo~.Zowing improvement
under the 'authora.ty o~' ~he Municipal Improvemen~ Act of ~.913:
Th~ construction of streets, including clearing,
grading, base, pavem~nt, storm drazr~age faci~.ities, a
~ ,sys~em of domestic wa~er suppl.y, incZud~ing fire
'hydran~s,.and undergro~nd uti~itie5, incZuding
electrical distr~bution facili~ies, tage~her with a~l
other improvements and appur~enances necessary foz a
compZete schem~ of public imp~'ovements within Paradi.s~
Bluffs Subdivisian Uni~ ~.. ~
'This Board finds that ~he land speci.ally benefzf.ed by
~he i.mprovement i.s shown wi~.hin ~.he boundaries o~ the map
enti~I~d, "Proposec~ Boundaries af ~aradise Bluffs Assessment
District No. 1, Coun~y of Butte, State of California." This map
has been app.roved by ~.he Board of Supervisors and i.s now an file
with the County Clerk. The land wa.t~in the ex~.erio~ boundaries
shown on the map shall be d~signafied Paradise 3~.uffs Assessment
D~strict No. l, B~tte County, California.
This Board intends to ~evy a special assessmen~ upon
the land wa.thin the described.distri~t a.n accordance wi~h the
special bene£it ta be recei.ved by each parcel of land,
respec~iv~ly, ~rom the irnprovemen~. There shall be omitted fro~+
special assessment a11 public streets, a~l.eys and pI.aces an.d all
~.and belongi.ng to ~the United Sta~es, the State of Cali~ornia,
and thi.s Coun~y now in us~ in the performance of a public
function. ~ ~

!Wh~re any dispa~ity occurs zn 1eve1 or size ~etween
the improvement and priva~~ prop~r~y, ~his Board determines that
it is in the public in~eres~ and more economicaZ to e~imina~e
~he dispari~y by do~ng work on the priva~e pxoperty in5tead of
adj~us~ing the work on pub~ic property. Accordingly, work may be
done on pr~vate proper~y for this purpose with the wri~ten
consent o~ the ~an~owner.
T~is Board intends ~o ent~r in~o an agreemen~ with
Paci~ic Gas and E1ec~ric Company and De~ Oro Wa~er Company under
the provisions of Sec~ion ~0~10 of ~he Streets and H~ghways
Cod~, inasm~ch as certain ~aci~iti~s inc~uded in ~~e impravemen~
are ~o be under their ownership, managem~n~ and con~rol.
Ser~al bonds represen~ing unpaid assessments o~ one
hundred fifty do~lars ($~50) or mo~e, and b~aring in~e~est at a
rate nat ~o exceed twelve percent (12~) per annum, wi11 be
issued in the manner provided in ~he Improvement Ac~ of 191~
(~ar~ 5 of Division 7, Streets and Highways Cod~}, and the last
ins~a~~ment o~ the bonds sha~~ mature fourteen years fro~ the
second day o£ January next succeeding the next Sep~ember lst
following the~~ date. The bonds sha11 be payable ~o bearer and
shal~ inc~ude a redemption premium of ~ive percen~ (5~) of the
unmaturea princ~pa~. ~
In case of d~fault, there sha~~ be added ta the
defaulted a~ount two percent {2~} of the amount ~he~eof, and on
the lst day of each month following 5uch defaUx~ ~her~ sha~Z be
added a~urth~r pena~ty of two percent ~2~) of 5uch d~faul~ed
amount. The ~wo perce~~ (2$) p~nalty ~irst ~mposed shall be

~etained by the Treasurer as a cost o~ servicing ~he delxnquency
and a~l subsequent penalties shall b~ paid ~o the hold~r of the
~ond along with and as a part of such defaulted paymen~.
This Boa~d ~inds that the 5pecial Assessment
Inves~iga~ion, Limitation and Majority Pratest Act o£ 1931
(comrnencing with Sec~ion 2800~ S~reets and ~ighways Code) does
not apply to these proceedings.
This Board appoints ~he Director o£ Public Works o~ ,
But~e County as ~ngineer of Wozk and Lzpp~ncott-Guth Assocxates
as Projec~ Engineer for thi~ projec~, and dizects the
prepara~zon o~ the repo~t r~quired by Section ~0204 of ~he
Stre~ts and Highways Code.
~n the apinian o~ ~his Board, t~e public in~erest will
no~ be served by allowing owners of assessab~e lands to enter
into a contract for the work of improvement as o~herwise
permitt~d in 5ec~ion ~4502.2 of the Streets and Highways Code.
The amount ot any surp~us remaining in the improvemen~
~und a£~Er comp~etion o~ the impravement and paymen~ of al~
c~aims sha~~ be transferred to the genezal fund if the surplus
does nat excee~ the lesser af ane t~ousand dol~ars t~iooa) or
~iv~ p~rcent (5~) o~ the tota~ amoun~ expended ~rom the ~un~.
~therwis~ th~ en~~re surpl~s shal~ b~ applied as a credit o~ the
assessment as provided in Sectzon 10427.~ of the Stzeets and
Highways Code.
