ESPLANADE A~INEXATION 3}ISTRICT N0. 12 - CONTI~ENTAL NtIT
FVHEREAS, oioners of property located Zaitllin Lsplanade A~~nexatian
District No. 12 - Continental Nut Company, have pet~.ti.onecl fox annexa-
tion to the City of Chico (copies of le~al descxi.ptinn and ~lat are attached
hereto as ~xhibit A and B); and
WHEREAS, the City of Chico has entered i~to a master I~roperty tax
a~resment entitled "Agreement Between Butte County and Cities Rega-rding
the Negotiated Exchange of Property Tax Revenues Related to Jurisdic-
tional Cl~ange (in Accordance with Revenue and Taxation Code Section 99
Added ~y Chapter Z82 Statutes o~ 1979 and Amended by Chapter 1161 of the
Statutes af 1979), (Agreement Amended January 3I, I980)," as per Revenue
and Taxation Code requirements; and
ti9HEREAS, the County CounseJ, has rendered an opinion stating
that the j•9aster Property 'z'ax ~lgxeement is not in effect; and
WHEREAS, the County af Butte does not Evish to delay ai~nexation
proceedings requested by these property owners.
vp}q~ ~`~;~~~p~ ~ BE IT I~SOLVED that the County of Butte agrees to
a property tax split for the above-mentioned annexation district wit~
60 percent of the praperty tax revenues, allocable to the City and County,
to be retained by the County, and 40 percent of said property tax xevenue
~o be paid to the Czty of Chico. Said 60a/40a splat to remaa.n in effect
for a11 years followi.ng annexation of said properties to the incorpora-
ted limits of the City af Chico, unless otherwise agreed to by the City
and County.
