HomeMy WebLinkAbout83-082~- -~ 4 Resolufion N0.83-82 RESOLUTION APPROVII+fG REPORT AND A55ES5MENT AND OItDEk2ING If~IPROVEMENF PARADiSE BLUFFS ASSESSNfENT DISTI2ICT N0. 1 The Board of Supervisors of the County of Butte resolves: This Board has taken a series of actions preliminary to ordering th2 improvement in Paradis~ Hluffs Assessment Bistrict No. 1 and now makes the foZlowing findings and orders: 1. The Soard adopted a map showing the boundaries of the 3and benefited by the proposed improvement. A copy of the boundary map was filed in the office of the County Recorder of the County of Butte in the Book of Maps of Assessment Districts. 2. The Board adopted its Resolution of Tntention to order the improvement described therein under the Municipal Improvement Act of 1913, and directed Lippincott-Guth Associates as the Project Engineer far the assessment'district, to prepare the report required by Section 1Q20~ of the Streets and Highways Code. The improvement is generally described as follows: The construction of streets, including clearing, grading, base, pavement, storm drainage €acilities, a system of c3omestic water supply, including fire hydrants, and under- ground utilities, including electrical distribution facilities, together with all other improvements and appurtenances necessary fpX a complete scheme of public improvements within Paradise Bluffs Subdivision Unit l. 3. The Project Engineer filed the report as directed, and the Board of Supervisors called a hearing on the report as required by 5ection 10301 of the Streets and Highways Code. Notice of the hearing was given by publication, by street posting and bp mailing to affected property owners, all according to the Municipal Improvement Act of 1913. Affidavits''of publication, posting and mailinq were filed with the County Clerk. ;~. At the time and place for which notice was given, the Board of Supervisors conducted a pubZic hearing and gave every interested pezson an;opportunity to object to the proposed improvement, the extent o€ the assessment district, or the ptoposed assessment. Following the hearing, at the direction of this Board, the Project Engineer filed an amended report. I5. The Board finds that written protest against the proposed improvement have not been made by owners representing more than one-half of the area of the land to be assessed for the improvement. I6. The documents and events described in paragraphs 1 to 4, inclusive,"~;are stated here in ~abular form, with their dates and, where appropriate, their numbers. Amendecl Engineer's Report filed 5/17/83 - 7. The Board approves the Amended Engineer's Report and each component part of i~, including each exhibit incorporated by reference in the report. 8. The Board finds that the Project Engineer, in the Amended Engineer`s!Report has fairly and properly apportioned the cost of the improvement to each parcel of land in the assessment district in proportion'to the estimated benefits to be received by each parcel, -2- respectively, from the improvement. The Board hereby confirms and levies each individual assessment as stated in the Amended Engineer'S Report. ' '9. This Board orders the improvement described in paragraph 2 and as de~ailed in the Amended Engineer's Report. !10. Serial bonds representing unpaid asse5sments of one hundred fifty do~lars ($150) or more, and bearing interest at a rate not to exceed twelve percent (12~) per annum, will be issued in the manne~ provided in the Improvement Act o£ 19~1 (Part 5 of Division 7, Streets and Highways Code), and the last installment of the bonds shall mature fourteen (14) years from the second day of January next succeeding the next September lst following.their date. The bonds shall be payable to bearer"and shall inclade a redemption premium of five percent (5~) of the unmatured principal. ill. Accarding ~o Section I0603 of the Streets and Highwaps Code, the'Board designates the County Treasu~er to collect and receive payment of the assessments. 12. The amount to be assessed against each of the parcels or subdivisions of land shown ont~e Amended Report does not exceed 75& of the market value of each.o€ the properties assessed after the cons- truction of improvements; and the appraisal of the market value of the properties to be assessed on fzle in these proceedings is hereby adopted as the market values of each o~ said parcels.
