WHEREAS, owners of property located within Colurrtbus Avenue Annexation
District No. 4 have petitioned for annexation to the City of Chico (copies
oflegal descriptions and plats are attached hereto as Exhibits A and B); and
4VHEREAS, the City of Chico has entered into a masYer proQerty tax
agreement entitl.ed "Agreement Between Butte County and Cities Regarding
the I~Tegotiated Exchange of Property Tax Revenues Related to Jurisdictional
Change (in Accordance with Revenue and Taxation Code §99 Addec~ by Chapter 282
StatuYes of 1979 and Amended by Chapter 1161 of the 8tatutes of 3979), (Agreement
Amended January 31, 198D)," as per Revenue and Taxation Code requirer?ments; and
WHEREAS, the County Counsel has rendered an opinion sYating that
the 114aster Property Tax Agreement is not in effect; and
WHERE.A.S, the County of Butte does not wish to delay annexation proceedings
requested by these property owners.
NOW, THEREk'ORE, BE IT RESOLVED that the County of Butte a~rees
to a property tax split for the above-mentioned annexation district with 60
percent of the property tax revenue, allocable to the City and County, to be
retained by the County, and 40 ~ercent of said property tax revenue to be
paid to the City of Chico. Said SO°'o/40% sp2it to remain in effect for all years
following annexation of said properties to the incorporated limits ef the City
of Chico, unless otherwise agreed to by the City and County.
