1VHEItEA5, Douglas Geyer Construction, Int., has petitioned
the Local Agency Formation Commission for the formation of County
Service Area No. 88, and
WHEREAS, the Butte County Loca1 Agency Formation Commissipn
has appxoved this formation, and designated it 83-10 - Formatinn qf
Cpunty Service Area No. 88 - Heritage Estates, the exteriar baundaries
af which are described in Exhibit A attached hereto and made a
part herenf by this reference, and
tiVHEREAS, the territory is uninhabited, and
tiVHEI2EA5, the reason for this formation petition is to assure
draina~e maintenance, and
WHEREAS, pursuant to the provisions of California Govarnment
Code Section 54797.1, the Butte County Loca1 Agency Formation
Commission has authorized the formation o£ this Cotutty Service Area
§ withou~ notice, hearing or an ele~tion, and
WH~12~AS~ an environmental impact report has been previously
considered and certified by this Board, and this formation wi11 have
no significant effect on the envixonment.
NOW, THEREFORE, BE IT RESOLVED, that the territory descri~ed
in Exhibit A, designated 83-10 - Faxmatian of County Service Area
No. 88, is hereby ~ormed.
PASSED AND ADOPTED by the Butte County Board. of Supervisors
