HomeMy WebLinkAbout83-121WHEREAS> the County of Butte has applied to the Governor for designation as a Service Delivery Area (SQA); and WHEREAS, the state and federal laws and regulations imp7ementing Public Lav~ 97-3Q0, entit~ed Jobs Training Partnership Act (Publ~c Law 97-300 - Octaber 13, 1982) requires the establishment of Private Industry Councils within a Service Delivery Area. NOW, THERE~ORE, BE IT RESOLVEp ~hat the Board of Supervisors of the County of Sutte hereby establishes the Private Industry Council of Butte County (PIC-BC) as follows: PURAOSE: The purpose of the Private Industry Council (PIC) is to prov~de through private business representat7ves in partnership with the county policy guidance and oversight with respect to the activities authorized under the Act. AUTHORITY: T~e Private Industry Council, with concurrence and agreement of ~he Board of Supervisors, shall develop a jobs training plan; select the admin~stering entity; and provide oversight of programs under the jobs training plan as specified under appl9cable law. ORGANIZATION: The Private Industry Council shall consist of nineteen {19) members to be appointed by the Board of Supervisors. Nomination from organizations representing general business groUps (i.e., Chambers of Co~~erce, merchants associations, farm bureaus, etc.) shall be coordinated to assure a single slate of nominees representative of private business. Other nominations shall be made by organizations representing education, organized labor and other groups representing the specific category of nomination. fi; The members shall consist of the following seats: ~en private ; .. , -- businesses (~ncluding agriculture); one organized labor; ~~+ro education; one community based organization; one economic deve1opment agency; one rehabilitation agency; one emp7oyment services agency; one ti ~-~ welfare administrator; and one Family Emergency Services Act representative. RESOLUTION ESTABLTSHTNG THE PRIVRTE INDUSTRY COUNCIL -2- Initially, the Private Industry Council shall be appointed to staggered terms as fo~lows: one year terms for four pr9vate bus~nesses, one ' education, one rehabilitation agency, and one Family Emergency Services Act representative; two year terms for three private bus9nesses; one we1fare administrator, one community based organization, and one employment services agency; three year terms for three private bus9nesses, one organized labor, one education; and one economic development agency. Successive appointments to the PIC shall be for three year terms. PIC members may be removed for cause upon recommenda~ion by the PIC and concurrence by the Board of Supervisors. Vacancies on the PIC shail be f911ed in the same manner as original appo~n~ments. QUALIFICATIONS: Each Private Industry Council r~embers shall meet the fol3owing qua1ifications for the representative groups: Private business. Representatives o~F the private sector who shall constitute a majority of the membership shall be owners of business concerns, chief executives or chief operating officers of non-governmental employers or other pr9vate sector executives who have substantial management or policy responsibility. Organized labor. Shall be a representative recommended by reCOgnized local labor organization(s} or appropriate building trades cauncils. ~aucation SF~all be nom~nated by local public or private educational agencies, institutions or genera7 educational organizations. Community based or~ar~izations. Shall be a representative of a cammunity based organization. The representative shall be recommended by community based organization{s). Economic deveZopment. Sha1Z be represented by a member of a local economic development agency. Rehabilitation a~. The representative shatl be recommended by Butte County rehabilitation agency(s). Employment services. Shall be represented by a manager or principal officer of the State Department of ~mployment Development. Welfare adminis~rator. Shal] be represented by an emplayee of the Butte County Welfare Department who has substantia7 managerial and policy responsibility. -3- Family Emergency Services Act. Shall be represented by a person as prescribed by state lav~. OFFICERS: The Private Industry Council shall establish its own rules and regulations for the election of officers. 7here shall be a Chair and Vice-Chair elected annually from the private business sector representatives. MEETINGS: The Private Industry Council sha1T meet regularly. Meetings shall be public and minutes shall be maintained of all meetings. CONCURRENT AUTHORITY: The Private Industry Council and tF~e Board of Supervisors shall have concurrent authority on all matters regarding the training plan and selection of the administering entity and grant recipients.
