RESOLUTION APPROVING AND EXECUTING THE AGREEMENT
BETWEEN THE NORTH BIJRBANIC PUBLIC UTiLITY DISTRICT
AND THE COUNTY itEGARDING fiHE EXCHANGE OF PROPERTY
TAX REVENUES REi,ATEI1 TO THE N.B.P.U.D. - CflFLEY
ACRES SiJBBIVISION ANNEXATION
WHEREAS, the provisions of the Revenue and Taxation Code
reauire an agreement between the County of Butte and special
districts considering annexations.
NOW, THEREFORE, BE TT R£SOL1f~D by the Board of Supervisors
that the Agreement attached hereto as Exhibit "A", is incorporated
herein as if set forth in full and is hereby approved and executed
by Butte County.

WHERE~IS, Part 0.5, of Diva,sxon ~, Secti.on 99, Subdivision B, paragragi~
5 of the Revenue and Tax.ation Cade prova.des as follows:
"Iii the event that *** a jurisdi,ctional change wauld
affect the service area or 5ervice responsa.hi~ity of one
or more spECia~ districts, the board of supervisars of the
county or counties in which *** the cfxstricts are ~ocated
shall, on behalf of the district or~ districts, negotiate any
^exchan~e of property tax reven.ues."

WHER~AS, said sectian of the Reven.ue and 7'axation Code further
provides in Section .99.1, Subsection (a}, paragraph 3i
"Notwithstanding the provisians af paragraph (5} of
subdivision (b) of Section 99, any s~ecial district affec~.ed
by ~he jur~sdictiona~ cr~ange may nego~ia~e on. ~ts own
bena?f, if it so chooses." ,

• WHEREAS, Section 99 further provides in Subsection $, paragraph $,
subpart (d}:

"vJitfi respect ~o adjus~ments in the allocation of property ~,
tax~s pursuant to this section, a county and any iocal agency
or agencies within the county may deve~op and adopt a r~aster
property tax trans~'er agreemen't. Such agi•eemznt may b° revi,sed
f'rom time ~o tim~ by the parties subject to such agreement."
