HomeMy WebLinkAbout83-147WHEREAS, California Constitution Article XIII A, as ap~r.oved by ~he voters as Proposition 13 at the June 6, 1978 primary elect9on, provides that property taxes levied on county assessed real property shall not exceed one percent {1.0%) of its full taxable value except for amounts required to meet payments on voter approved deb~ and assessments levied on other than an ad valorem base; and WHEREAS, the State Legislature has enacted s~atutes to implement the provisions of said Article XIII A; and WHEREAS, Section 93 of the Revenue and Taxation Code provides that no taxing entity other than the County sha71 levy an ad valorem property tax except for the amounts needed to make annual payments on general obligation bonds or other indebtedness approved by the voters prior July 1, 1978; and WHEREAS, Sections 135 and 93 af the Revenue and Taxation Code provide that the County shall levy an ad valorem property tax on a11 taxable value at a rate equal to one do3iar ($7.00} per one hundred dollars (~100.00) of full taxab7e value, and that the revenue from such tax levy shal~ be distributed to all of the taxing entit~es within the County in accordance with prevail9ng sta~utes; and WHEREAS, amounts needed for annua~ voter approved debt payments, and the respective tax rates required to raise such amounts, have been determined by the County Auditor; and WHEREAS, it is incumbent on the Board of Superv~sors to fix the tax rates for certain entit3es within the County, pursuant to Article 5, Division 3, Titl~ 3 (Section 29100 et seq) of the Governmen~ Code, for the 1983-1984 fisca7 year; NOW, TI~EREFORE, 8E IT RESOLVED by the Board of Supervisors of the County af Butte, State of California, as follows: 1. That sai:d Board does hereby fix a tax rate of one doilar (~1.00) per one hundred doilars ($100.00) of full taxable value to be appl~ed to the total taxable property incTuded on the 1983-1984 Secur~d Property Tax Roll as comp~led by the County Assessor and the State Board of .Equalization. 2. Tha~ the revenues derived from said tax rate and levy shall be distributed to the various taxing entit~es in ~he County, as prescribed by statute, by the County Auditor; and That said Board does hereby fix various tax rates per one hundred dollars (~100.00) of full taxable value, as hereinafter set forth, fo be applied to the taxable values within the boundaries of the respective en~ities on the 1983-1984 S~cured Property Tax Roll, as compiled by the Caunty Assessor and the State Board of Equalization, to raise revenues required to meet annual payments on voter approved bonds and other indebtedness. Revenues derived from such tax rates and levies shali be distributed ta the various entities pursuant to prevailing law:.
