A RESOLUTION OF THE BOARD OF SUPER'VISORS OF THE
COUN'TY OF BUTTE, ADOPTING A SPECIF'IC PLAN
PURSUANT TO GOVERNMENT CODE § 65350
WHEREAS, pursuant to the provisions of Government Code
§65350, et. seq., public hearings were held befoxe the Butte County
Boarc~ of Supervisors on a proposed Specif3.c ~lan £or Bidwell
Heights; and
WHEREAS, the procedures of the California EnvironmenCal
Quality Act and the Butte County Resolvtion implementing the act,
have been met, and the hereinafter listed matter was discussed
with testimony and documentation presented by the public, and various
county, local, and stare agencies; and

NOW, THERB~'ORE, LE'I' IT BE RESOLVED rhat ehe Board of
Supervisors of the County of Butte in regular session assembled on
September 20, 1983 makes rhe following findings on ~he ma~rer:
l. That the Specific Plan is in conformance with aIl
elemenrs of the Butte County General Plan.
2. The Specific Plan, as proposed with policies L 1
through 4.4, will mitigate concerns enumerated in the
Environmental Impact Report.
3. The Specific Plan has left a substantial portion of
the groject site in open space including deer migration
corridors.
~+. The Specific Plan includes formation of a special
district to provide a legally binding mecranism to
assess property owners for needed levels of services.
5. Tk~e Specific Plan, with the conditions for circulation,
access, drainage, erosion, sanitation, water, fire
prorection, open space, geologic hazards, wildlife
habitat and services to be p~covided by a County

Service Area and/or community Services District, wilX
implement the general plan and each of its elements
and provide for the public safety.
BE ZT FURTHER RESOLVED that most adverse environmental
impacts havE been mitigated by the Speci~ic P1an with a statement of
overriding considarations adopted for those significant impacts
that can be reduced, but not eliminated,
BE IT FURTHER RESOLVED that the Board oF Supervisors,
pursuant to the California Environmenta~ Quality Act and the Butte
County R~solution implementing C~QA, reviewed and considered the
Draft EIR, in its evaluation of the proposed Specific Plan and
certified tihe EIR on August 16, 1983.
NOW, THEREFORE, BE IT RESOLVED that the Butte County Board
of Supervisoxs at its regular meeting held on September 20, 1983
approved the ~pecific Plan of the Bidwell Heights Land Company (Dan
Hays, etaX) fox Bidwell Heights.
PASSED AND ADOPTED by the Board of Supervisors of the
County of Butte, State o~ California, the 20th day of September, 1983,
