HomeMy WebLinkAbout83-163WHEREAS, on June 7, 1983, the Butte County Board of Supervisors passed and
adopted Resolution No. 83-91 making application to the Local Agency.Formation Commission
for the proposed dissalution of County Service Area No. 35; and,
WNEREAS, on August 4, 1983, the Loca~ Agency Formation Commission passed and
adopted Resoiution No. 83-20 approving the proposed dissolution of County Service Area
No. 35; and,
WHEREAS, the reason for the proposed disso~ution o~ County Service Area
No. 35 is that the installation of fire hydrants is no longer necessary; and,
WHEREAS, the Butte County Board of Supervisors held a public hearing on said
proposed dissolution.
NOW, TNEREFORE, BE TT RESOLUED by the Butte County Board of Superv~sors
as follows:
7. That County Service Area No. 35 is hereby disso~ved. The boundaries
af said County Service Area No. 35 are described in Exhibit "A" attached hereto>and
made a part hereof by this reference.
2. Pursuant to Rev~nue and Taxation Code Section 99, the funds generated
within County Service Area No. 35 ~ar structural fire protection services shell be
transferred to the County of Butte and used to provide fire protect~on services within
the geograph~cai area formerly serviced by County Service Area No. 35.
3. Pursuant to Revenue and Taxation Code, the funds held in trust shall be
used to purchase a water tender, the equipment needed to put the unit in service and to
construct a facility to house the unit.
4. That all obligations due and owing by Caunty Service Area No. 35 shall
be assumed by the Coun~y of Butte.
