This matter came on regularly for hearing before the Board
of Super.visors of the County of Sutte, State of California, on
tvovember 15 , 1983, in the Board Chambe~s, Butte County Administration
Building, Oroville, California, and it appearing to said Board that
a Notice of Time and Place of Hearing of said Abandonment was duly
and regularly given as r.equired by law, and testimony and evidence,
both oraX and documentary, having been produced at said hearing,
from which said Board now finds that the heteinafter described
Public Utility Easement is unnecessary for present or prospective
public use.
NOW, THEREFORE, IT IS HEREBY ORDERED as follows:
l. That the public utility easement situated in the County
of Butte, State af CaLifornia, as heLeinafter more particularly
described is heteby abandoned.
2. That the description of said public utility easement
so abandoned is situated in the County of Butte, State ofr California,
and more par.ticularly described as follows:
Ke1~ly Ridge ~states, Unit 2B
Lot 99, Public Utility Easement
Being that certain fi-foot public utility easement lqing
within a portion of the south 1/2 0~ Section 1, TI9N,
R4E, MDM, as shown on the map on Lot 99, Kelly Ridge
Esatates, Unit 2B, recorded in Book 43 Maps of Record
at Pages 27 to 29, County of Butte, State of California,
u~ore particularly described as follows:
Being that certain 6-foot public utility easement lying
southwesterly of and contiguous ~o the northeasterly
1ot line of said Lot 99, beginning at the southeasterly
corner of said Lot 99; thence N 27° 37' 16" W, 143.71 ~
feet to the northeasterly cor.ner of said Lot 99. =~
Excepting therefrom the northwesterly 20 feet iying ~
within the 20-foot building setback line. ~'~

3. That the Clerk of this Board shall cause a certified
copy of this Resolution, with the seal of the Boar.d of Supervisors
of the County of Butte, State of Califor.nia, to be recorded in the
off~ce vf the Recordet of the County of Butte, State of California.
