HomeMy WebLinkAbout83-189RESOLUTION AMENDING SECTION 12.14(j) OF THE BUTTE COUNTY PERSON~EL RULES WHEREAS, the Board of Superv~sors finds it to be in the interest of the County to amend the Personne3 Ru7es. NOW, THEREFORE, BE IT RESOLVED, the Board of Supervisors of the County of Butte hereby amends Section 12.14(j) of the Personnel Rules of the County of Butte to read as follows: 12.14 OVERTIME j. Exempt Emp7oyees The overtime provis9ons of this section shall not apply to department heads or to Management, Confidential or Supervisory positions as defined in these rules. Except as provided, an incumbent in a position defined as Management, Confidential of Supervisory or appointed department head, shall receive administrative leave ~n lieu of paid overtime. Administrative leave in lieu of pafd overtime shall be accumulated at a rate of O.i923 days for each b~weekly period of compensated service (five days per year). Admin~strative leave may be accumulated to a maximum of (40) forty days. Employees who ~erminate from the County in good standing sha11 be compensated for any administrative 1eave accrued under this section, up to the maximum accrued amount. Incumbents in positions defined as Management, Confidentiai or Supervisory, who pr~or to Decerober 24, 1977 were elig~ble for the paid overt~me provisions of these ru~es, shaZl continue to be elig~ble to receive overtime pay or compensatory time. Such incumbent may, through written mutua~ agreement with the appointing authority convert from the overtime provisions of these rules to the in-lieu administrative leave provisions. Once such agreement is reached, it shall not be reversible for the position. Whenever a Management, Confident~al or Supervisory posit~on for whic~ the campensated overt~me provisions app7y becomes vacant, the position shall be identified as one to receive administrative leave in lieu of overtime before ~he pos~tion is refi7led. Whenever a new Management, Confidential or Superv3sory position is created or designated pursuant to these rules, it shall be exempt from overtime;provisions of these rules and the in-lieu administrative leave practices shall apply to the position.
